. <br />7 f <br />BY: i)flt <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 85 - 37 <br />AN ORDINANCE AUTHORIZING THE SALE OF SURPLUS <br />PERSONAL PROPERTY OWNED BY THE CITY OF NORTH <br />OLM.SSTED AND PREVIOUSLY USED BY THE DEPAR'I!MENT <br />OF PUBLIC SERVICES, AND DECLARING AN IlMERGENCY. <br />WHEREAS, the Council and the Administration have determined that <br />various items of personal property owned by the City of North Olmsted <br />and formerly used by the Department of Public Services are no longer <br />needed f'or municipal purposes, and <br />WF-iEREAS, it is the desire of this Council to sell said personal <br />property in accordance with law. <br />NOW, TI-IEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OL,NISTED, COUNrl'Y OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the following personal property was formerly <br />used by the Department of Public Services and is no longer needed for <br />municipal business, to wit: <br />See attached Schedule "A" made a part <br />hereof as though fully rewritten herein. <br />SECTION 2: That the Mayor be and he is hereby authorized to sell <br />said personal property to the highest bidder according to law, provided <br />however, that the highest bid is approved by the Board of Control and <br />further provided that the highest bidder, shall, upon acceptance of the <br />bid, pay to the Director of Finance of the City of North Olmsted, twenty- <br />five percent (25%) of the bid price and that within five (5) days there- <br />after, the entire bid price shall be paid and the successful bidder shall <br />accept and remove said property from the premises of the City. The Ma.yor <br />having been advised upon the receipt of the full bid price, shall, if <br />necessasy, execute any and all documents by law. <br />SECTION 3: 'I'hat this Ordinance is hereby declared to be an emer- <br />gency measure i.rr?nediately necessary for the preservation of the public <br />health, safety,and welfare and for the further reason that the sale of <br />surplus equipment is necessary to protect the value thereof for resale <br />purposes. <br />PASSED: <br />A'I'I'EST : <br />(? • <br />b7ARENCE E.
