? <br />CITY OF iVORTH OLMSTED <br />ORDINANCE N0. 85 - 23 <br />BY: Ron Wilamosky <br />AN ORDINANCE AUTHORIZING THE BUILDING COMMISSIONER <br />TO PROCEED WITH THE DEMOLITION OR REMOVAL OF THE <br />THREE (3) DETACHED STRUCTURES ON PERMAIVENT PARCEL <br />N0. 234-10-3 AT 30993 LORAIN, IN THE CITY OF NORTH <br />OLMSTED, AND DECLARING AN EMERGENCY. <br />WHEREAS, pursuant to the provisions of Ordinance No. 133.01 and <br />1331.99 of the Codified Ordinances of the City of North Olmsted, the <br />Building Commissioner has determined that three (3) detached structures <br />known as Permanent Parcel No. 234-10-3 located at 30993 Lorain Road, North <br />Olmsted, Ohio, the record title holder being Leonard Van, are unsafe, <br />dangerous to human life and hazardous to the safety, health, and public <br />welfare of the citizens of the City of North Olnsted; and <br />WHEREAS, notice to repair, remove, or demolish said buildings was sent <br />via certified mail, return receipt requested to Leonard Van, on December <br />10, 1984, at 3507 Cleveland Road, Huron, Ohio, ordering said title holder <br />to repair, remove, or demolish said buildings and to commence such repair, <br />removal, or demolition within sixty (60) days of receipt of said notice; <br />and <br />WHEI.EAS, said record title holder, Leonard Van failed to reverse the <br />Building Conmissioner's order and also failed to further appeal the <br />decision of the Zoning Board of Appeals to a higher tribunal of competent <br />jurisdiction and this time has failed to comply with the order of the <br />Building Commission. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PdORTH <br />OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That Council deems it necessary to proceed with the <br />demolition and removal of the unsafe structures at 30993 Lorain Road, North <br />Olmsted, also known as Permanent Parcel Number 234-10-3, owned by Leonard <br />Van, whose mailing address is 3507 Cleveland Road, Huron, Ohio, by reason <br />of the fact that said structures have been determined to be dangerous to <br />human life and a hazard to the public safety, health and welfare of the <br />citizens of the City of North Olmsted, Ohio, and that the cost of said <br />demolition and removal be paid from the General Fund of the City of North <br />Olmsted and charged to the owner as a special assessment or lien on such <br />parcel of land and assessed and collected in the manner or other <br />assessments as provided by law. <br />SECTION 2: That the Clerk of Council be and she is hereby direct to <br />forward a copy of this Ordinance to Leonard Van, 3507 Cleveland Road, <br />Huron, Ohio 44839. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency <br />neasure immediately necessary for the preservation of the public health, <br />safety and welfare, and for the further reasons that the dilapidated <br />condition of said dwellings are a serious hazard to the health, safety, and
