. <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 85 - 22 <br />BY: MR. 0' GRADY <br />AN ORDINANCE AUTHORIZING THE BUILDING COMNIISSIONER <br />TO PROCEED WITH THE DEMOLITION OR REMOVAL OF THE <br />DETACHED BARN/GARAGE ON PERMANENT PARCEL N0. 231- <br />31-6 AT 24262 LORAIN ROAD, IN THE CITY OF NORTH <br />OLLMSTED, AND DECLARING AN EMERGENCY. <br />WHEREAS, pursuant to the provisions of Ordinance No. 133.01 and <br />1331.99 of the Codified Ordinances of the City of North Olmsted, the <br />Building Commissioner has determined that the abandoned structure known as <br />Permanent Parcel No. 231-31-6 located at 24262 Lorain Road, North Olnsted, <br />Ohio, the record title holder being Harold P. Murton, is unsafe, dangerous <br />to human life and fiazardous to the safety, health, and public welfare of <br />the citizens of the City of North Olmsted; and <br />WHEREAS, notice to repair, remove, or demolish said building was sent <br />via certified mail, return receipt requested to Harold P. Murton, on <br />December 10, 1984 at 2048 Magnolia Drive, Rocky River, Ohio, ordering said <br />title holder to repair, rernove, or denolish said building and to commence <br />such repair, removal, or demolition within sixty (60) days of receipt of <br />said notice; and <br />WHEREAS, said record title holder, Harold P. Murton failed to reverse <br />the Building Commissioner's order and also failed to further appeal the <br />decision of the Zoning Board of Appeals to a higher tribunal of competent <br />jurisdiction and this time has failed to comply with the order of the <br />Building Cornmission. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That Council deerns it necessary to proceed with the <br />demolition and removal of the unsafe structure at 24262 Lorain Road, North <br />Olinsted, also known as Permanent Parcel Tdumber 231-31-6, owned by Harold P. <br />Nlurton, whose cnailing address is 2048 Magnolia Drive, Rocky River, Ohio, by <br />reason of the fact that said structure has been determined to be dangerous <br />to human life and a hazard to the public safety, health and welfare of the <br />citizens of the City of North Olmsted, Ohio, and that the cost of said <br />demolition and removal be paid from the General Fund of the City of North <br />Olmsted and charged to the owner as a special assessment or lien on such <br />parcel of land and assessed and collected in the manner or other <br />assessments as provided by law. <br />SECTION 2: That the Clerk of Council be and she is hereby direct to <br />forward a copy of this Ordinance to Harold P. Murton at 2048 Magnolia <br />Drive, Rocky River, Ohio 44116. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency <br />measure irnmediately necessary for the preservation of the public health, <br />safety and welfare, and for the further reasons that the dilapidated <br />condition of said structure is a serious hazard to the health, safety, and
