<br />AN ORDINANCE AUTHORIZING THE BUILDING COMMMISSIONER
<br />TO PROCEED WITH THE DEMOLITION OR REMOVAL OF THE
<br />DETACHED BARN ON PERMANENT PARCEL N0. 231-19-5 AT
<br />3691 COLUMBIA ROAD, IN THE CITY OF NORTH OLMSTED,
<br />AND DECLARING AN EMERGENCY.
<br />WHEREAS, pursuant to the provisions of Ordinance No. 133.01 and
<br />1331.99 of the Codified Ordinances of the City of Pdorth Olmsted, the
<br />Building Commissioner has determined that the abandoned structure known as
<br />Permanent Parcel No. 231-19-5 located at 3691 Columbia Road, North Olmsted,
<br />Ohio, the record title holder being Richard McKay, is unsafe, dangerous to
<br />human life and hazardous to the safety, health, and public welfare of the
<br />citizens of the City of North Olmsted; and
<br />WHEREAS, notice to repair, remove, or demolish said building was sent
<br />via certified mail, return receipt requested to Richard McKay, on December
<br />129 1984, at 7515 Company, 7515 Pearl Koad, Cleveland, Ohio, ordering said
<br />title holder to repair, reniove, or demolish said building and to commence
<br />such repair, removal, or demolition within sixty (60) days of receipt of
<br />said notice; and
<br />WHEREAS, said record title holder, Richard McKay failed to reverse the
<br />Building Commissioner's order and also failed to further appeal the
<br />decision of the Zoning Board of Appeals to a higher tribunal of competent
<br />jurisdiction and this time has failed to comply with the order of the
<br />Building Commission.
<br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH
<br />OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO:
<br />SECTION l: That Council deems it necessary to proceed with the
<br />demolition and removal of the unsafe structure at 3691 Columbia Road, North
<br />Olmsted, also known as Permanent Parcel Number 231-19-5, owned by Richard
<br />IKcKay9 whose rnailing address is c/o 7515 Company, 7515 Pearl Road,
<br />Cleveland, Ohio, by reason of the fact that said structure has been
<br />determined to be dangerous to human life and a hazard to the public safety,
<br />health and welfare of the citizens of the City of idorth Olmsted, Ohio, and
<br />that the cost of said demolition and rernoval be paid from the General Funcl
<br />of the City of North Olmsted and charged to the owner as a special
<br />assessment or lien on such parcel of land and assessed and collected in the
<br />manner or other assessments as provided by law.
<br />SECTION 2: That the Clerk of Council be and she is hereby direct to
<br />forward a copy of this Ordinance to Richard McKay at 7515 Pearl Road,
<br />Cleveland, Ohio 44130.
<br />SECTION 3: That this Ordinance is hereby declared to be an energency
<br />measure immediately necessary for the preservation of the public health,
<br />safety and welfare, and for the further reasons that the dilapidated
<br />condition of said structure is a serious hazard to the health, safety, and
