CITY OF NORTH OLMSTED <br />ORDINANCE N0. 85 - 12 <br />BY: Mrs. Saringer <br />AN ORDINANCE AMENDING CHAPTER 739 OF THE <br />CODIFIED ORDINANCES ENTITLED "GASOLINE SERVICE <br />STATIONS" BY ADDING THERETO A NEW SECTION <br />739.03 ENTITLED "AIR PUMPS REQUIRED", <br />WHEREAS, this Council has been made aware of the fact that gasoline <br />service stations over the past several years have gone from full service <br />stations to self service stations; and <br />WHEREAS, this Council is further aware of the fact that self service <br />stations have a tendency not to provide all of the things necessary for <br />simple maintenance of vehicles; and <br />WHEREAS, this Council desire to make it mandatory that service <br />stations be required to maintain on their property air pumps for the <br />inflation of automobile tires. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That Chapter 739 of the Codifed Ordinances entitled <br />"Gasoline Service Stations" be amended by including therein a new Section <br />739.03 entitled "Air Pumps Required"which new Section shall read as <br />follows: <br />739.03(A) AIR PUMPS REQUIRED <br />All gasoline service stations within the City must provide on the <br />premises, where motor fuel is sold at retail for the use in motor <br />vehicles a functioning motor-driven air compressor capable of <br />inflating automobile tires for use by customers during hours in which <br />such station is open for business. Gasoline service station as used• <br />in this Section shall mean any dealer owning or operating a premises <br />or facility with four (4) or more gas dispensing nozzles for the <br />retail sale of motor fuels for use in motor vehicles. <br />739.03(B) <br />Willful failure to comply with the provisions of this Section <br />shall subject a dealer to civil penalty of up to $25.00 for each such <br />failure occurs. If the failure to comply results from a breakdown of <br />the air compressor, the failure to repair within a reasonable time <br />shall constitute willful conduct. <br />SECTION 2: That this Ordinance shall take effect and be in force from <br />and after the earliest period allowed by law.
