' r CITY OF NORTH OLMSTED ORDINANCE N0. 85-7 BY: RONALD TALLON AN ORDINANCE AMENDING SECTION 1202.02 OF THE ZONING CODE ENTITLED "USES PERMITTED" OF CHAPTER 1201 OF THE ZONING CODE ENTITLED "AREA USES AND STANDARDS IN MIXED USE DISTRICTS A AND B"5 AS pMEiNDED. WHEREAS, this Council has reviewed the permitted uses in the Mixes Use District; and WHEREAS, after having reviewed said uses, this Council has determined that the concept of mixed use should be broadly construed so as to permit a number of uses in that district, in such a fashion that the same are blended in accordance with proper design standards, as well as planning standards; and WHEREAS, the present Mixed Use District is not specific, with respect to permitted uses; and WHEREAS, it is the desire of this Council to specifically set out the various uses permitted. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION l: That Section 1202.02 of the Zoning Code entitled "Uses Permitted" which now reads: (a) Mixed Use District A Any of the following uses as defined in Sections 1202.03 and 1202.04 shall be permitted. (b) Mixed Use District B Any of the uses as defined in Section 1202.05 and Sections 1151.01 and 1151.02. be and the same is hereby amended and as amended shall read as follows: 1202.02 Uses Permitted (a) Mixed use District A Any of the uses as defined in Sections 1202.03 and 1202.04 shall be permitted. Additionally, uses permitted in a general retail business district, as set forth in Chapter 1173, shall be permitted provided however, that the plan of development neets all of the requirements and restrictions set forth in Chapter 1203, and further provided that the proposed use is approved by the Planning Commission, who shall determine whether it has been integrated into the plan in such a manner as will promote the intent and purposes of a mixed use development.
