CITY OF NORTH OLMSTED ORDINANCE N0. 86 - 117 BY: Ronald J. Tallon AN ORDINANCE ACCEPTING AN EASEMENT FOR THE INSTALLATION AND MAINTENANCE OF A WATER LINE FOR THE PURPOSE OF CIRCULATING WATER SERVICE BY THE CITY OF CLEVELAND THROUGH LAND OWNED BY HOMELINKS, INC., AND THE SUNRISE DEVELOPMENT COMPANY, AND DECLARING AN EMERGENCY. WHEREAS, Homelinks, Inc., and the Sunrise Development Company desire to extend a water main through their property to circulate water to the Eliza Jennings project, and WHEREAS, the City of Cleveland requires that extension of water lines shall only be approved if easements are granted to both the City of Cleveland and to the City of North Olmsted in order that water mains may be constructed and maintained therein, and WHEREAS, this Council deems it in the best interest of the City of North Olmsted to accept the easement described herein; attached Exhibit "1". NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That this Council does hereby accept an easement from Homelinks, Inc., and the Sunrise Development Company for the installation and maintenance of a water main for the purpose of circulating water service by the City of Cleveland through the property of Homelinks, Inc., and the Sunrise Development Company. SECTION 2: That the Clerk of this Council is hereby authorized to forward a certified copy of this Ordinance to the Director of Public Utilities of the City of Cleveland. SECTION 3: That it is found and determined that all formal actions of this Council concerning and relating to the adoption of this Ordinance were adopted in an open meeting of this Council, and that all deliberations of this Council and of any of its committees that resulted in such formal.action, were in meetings open to the public in compliance with all legal requirements, including Section 121.11 of the Ohio Revised Code.
