C ? <br /> <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 86 - 114 <br />BY: Ronald Wilamosky <br />AN ORDINANCE ESTABLISHING A LAW ENFORCEMENT TRUST <br />FUND PURSUANT TO OHIO REVISED CODE SECTION 2933.43(D) <br />AND DECLARING AN EMERGENCY <br />WHEREAS, effective September 3, 1986, the Ohio Legislature passed a law <br />relative to the seizure and forfeiture of contraband, the procedures <br />involved therein, and the ultimate disposition of contraband which has been <br />forfeited, and <br />WHEREAS, contained within said law is the requirement that municipal <br />corporations provide for the establishment of a trust fund wherein is <br />deposited funds from the sale of contraband or monies forfeited which can <br />only be used for certain purposes, and <br />WHEREAS, it is the desire of this Council to establish a trust fund <br />pursuant to Ohio Revised Code Section 2933.43(D). <br />NOW THEREFORE, BE IT ORDAINED BY THE CITY OF NORTH OLMSTED, COUNTY OF <br />CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That pursuant to Ohio Revised Code Section 2933.43(D) the <br />City of North Olmsted does hereby establish a law enforcement trust fund <br />which shall consist of the proceeds of the sale of contraband which has <br />been lawfully seized and forfeited to the City of North Olmsted Police <br />Department pursuant to the provisions of R.C. Section 2933.43(C). Proceeds <br />distributed to the fund shall be allocated from the fund by the North <br />Olmsted City Council to the North Olmsted Police Department and shall be <br />expended only for the following purposes: 1) To pay the costs of <br />protracted or complex investigations or prosecutions; 2) To provide <br />reasonable technical training or expertise; 3) To provide matching funds <br />to obtain federal grants to aid law enforcement; or 4) For such other law <br />enforcement purposes as the North Olmsted City Council determines to be <br />appropriate. The fund shall not be used to meet operating costs of the <br />City of North Olmsted that are unrelated to law enforcement. <br />SECTION 2: That this Ordinance hereby repeals any other ordinance or <br />parts of ordinances inconsistent herewith. <br />1
