<br />Rev. 4,l,bJ ? <br />? <br />A <br /> <br />SECTION V (Maintenance and Parking) <br />That upon completion of •ald lmprovemant, eaid City, will thereafter keep said highvay open to <br />traffic at all timee, and <br />(a) Maintain the improvement in accordanca wlth the proyialona of the •tatutea <br />relatinq thereto and wake ample financial and othez provisions for such <br />maintenancet and <br />(b) Maintain the right-of-way and keep i[ free of Dbstzuctiona in a manner satic- <br />factory to the State of Ohio and hold caid right-of-way inviolate foz public <br />highway purposes and permit no signs, postera,billboazda, roadaide standc <br />or other pzivate installations within the right-of-way limitsj and <br />(c) Place nnd maintain all traffic control devices conforming to the Ohio Manual <br />of Uniform Traffic Contzol Devices on the impzovement in cowpliance with the <br />provisions of Section 4511.11 and related sections of the Ohio Revised Code. <br />(d) Aegulate parking in the following mannez: <br />prohibit parking within the limits of the project <br />?• ?• <br />•? <br />SECTION VZ (Right-of-way, Utility Rearzangement and Saving the State of Ohio Harmless <br />of Damages) <br />(a) That all existing street and public way right-of-way within the City vhich <br />is necessary for the aforesaid lmprovement, shall be made available therefor. <br />(b) That the NIUMCity will acquire any additiunal iiqht-of-way required for <br />the construction of the aforesaid impzovement. <br />(a),,,..That azrangements have been or will be tnade with and agreements obtained ? <br />from all public utility companies whose lines or structures will be affected <br />by the said improvement and siad companies have agzeed to make any and all <br />necessary plant removals or rearrangements in such a manner as to be clear <br />of any construction called foz by the plans of said improvement and said <br />companies have agreed.*p make such necessary rearrangements immediately after <br />notification by said City or the Department of Transportation. <br />(d) That it is hereby agreed that the City shall at ?ts own expense, make all <br />rearzangements of water mains, service'lines, fi e hydzants, valve boxes, <br />sanitary sewers or other municipally owned ntilipies and/or any appurtenances <br />thereto, which do not comply with the provisions.of Directive 28-A, whether <br />inside or outside the cozporate limits as may be nececsary to conform to the <br />said improvemeni and said reazrangements shall be done at such time as ze- <br />quested by the Department of Transportation Engineer. <br />(e) That the constzuction, reconstruction, and/or rearranqement of both publicly <br />and privately owned utilities, refezred to in subsections (c)-and (d) above, <br />shall be done in such a manner as not to intesfere unduly with the operation <br />of the contractor constructing the improvement and all backfilling of <br />trenches made necessary by such utility rearrangements shall be performed in <br />accordance with the provisions of the Ohio Department of Transpoztation <br />Construction and Material Specifications and shall be subject to appzoval by <br />the State. <br />(f) That the installation of all utility facilities on the right of way ehall <br />conform vith the requirements of the Federal Highway 7?dministzation Policy <br />and Procedure riemorandum 30-4 "Utility Relocations and Adjustments" andlthe <br />Department of Tzansportation's rules on Utility Acco?nodation. <br />(g) That said City hereby agrees that the said Department of Tranaportation of <br />the State of Ohio, shall be and is hereby saved harmless from any and all <br />dama9es or claims thereof arising fzom or groving out of the eertifieation <br />or obligations made oz agreed to in Sections (a), (b). (c), (d) and (e) <br />hereinabove.
