; <br />CITY OF NORTH OLMSTED <br />RESOLUTION N0. 86- 97 <br />BY: MAYOR M. YVONNE PETRIGAC <br />A RESOLUTION URGING THE CONGRESS OF THE UNITED STATES TO <br />ADOPT LEGISLATION ELIMINATING THE NOTCH IN THE SOCIAL <br />SECURITY SYSTEM AND DECLARING AN ENIERGENCY. <br />WHEREAS, amendments to the Social Security law in 1972 and 1973 <br />provided for automatic response to benefits as a result of the rate of <br />inflation; and <br />WHEREAS, the formula used to build in the cost-of-living protection <br />contained an error which in effect adjusted for inflation once in the wage <br />part of the formula and once in the base benefit amount; and <br />WHEREAS, in 1977 Congress revised the benefit formula to correct the <br />error. The correction consisted of providing that people born in 1916 or <br />earlier would continue to have their benefits calculated under the benefit <br />formula in effect before the 1977 change was made. In effect the 1977 <br />changes reduced the amount of benefits for those born after 1916 and <br />created a special five year transition period to ease the 1977 changes. <br />Individuals affected by these transitional rules are those born between <br />1917 and 1921 and have become now known as the "notch babies;" and <br />WHEREAS, these transitional rules failed to prevent many "notch <br />babies" from receiving significantly lower benefits than recipients with <br />similar earnings records born in 1916 or earlier. The technical reasons <br />for this are less important than the fact that people born only a few <br />months or weeks apart may receive quite different benefits despite similar <br />earnings records; and <br />WHEREAS, there is presently pending before Congress a Bill known as HR <br />1917 which is designed to correct the present deficiencies in the Code to <br />eliminate the discriminatbry treatment of the "notch babies". <br />NOW, THEREFORE, BE IT RESOLVED BY COUNCIL FOR THE CITY OF NORTH <br />OLMSTED, CUYAHOGA COUNTY AND STATE OF OHIO: <br />SECTION 1: That this Council does hereby urge the Congress of the <br />United States of America to correct the deficiency which exists in the <br />Social Security System as is outlined herein. <br />SECTION 2: That the Clerk of Council be and she is herebp directed to <br />1
