CITY OF NORTH OLMSTED <br />ORDINANCE N0. 86 - 84 <br />BY: Janet A. Saringer <br />AN ORDINANCE ACCEPTING AN EASEMENT FOR THE INSTALLATION <br />AND MAINTENANCE OF A WATER LTNE FOR THE PURPOSE OF SUPPLYING <br />WATER SERVTCE BY THE CITY OF CLEVELAND TO LAND OWNEb BY THE <br />GREAT NORTHERN SHOPPING CENTER PARTNERSHIP, AND DECLARING <br />AN EMERGENCY. <br />WHEREAS, Great Northern Shopping Center Partnership desires to <br />extend a water main into tiheir property for the Corporate Center <br />Development, and <br />WHEREAS, the City of Cleveland requires that extension of water <br />lines shall only be approved if easements are granted to both the <br />City of Cleveland and the City of North Olmsted so that water mains <br />may be constructed and maintained therein, and <br />WHEREAS, this Council deems it in the best interest of the City <br />to accept the easement described herein; attached Exhibit "A". <br />NOW, THEREFORE, BE IT ORDATNED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That this Council does hereby accept an easement <br />from Great Northern Shopping Center Partnership for the installation <br />and maintenance of a water main for the purpose of supplying water <br />service by the City of Cleveland to property of Great Northern <br />Shopping Center Partnership. <br />SECTION 2: That the Clerk of this Council is hereby authorized <br />to forward a certified copy of this Ordinance to the Director of <br />Public Utilities of the City of Cleveland. <br />SECTION 3: That it is found and determined that al1 formal <br />actions of this Council concerning and relating to the adoption of <br />this Ordinance were adopted in an open meeting of this Council, and <br />that all deliberations of this Council and of any of its committees <br />that resulted in such formal action, were in meetings open to the <br />public in compliance with all legal requirements, including Section <br />121.22 of the Ohio Revised Code. <br />SECTION 4: That this Ordinance is hereby dtionbofathe <br />emergency measure immediately necessary for the preserva <br />public health, safety and welfare, and for the further reason that <br />it is necessary to accept said easement in order that the developer <br />may have water available at the time of completion of the building <br />for occupancy, and further provided it receives the affirmative vote <br />of two-thirds of all members elected to Council, it shall aeffect <br />and be in force immediately upon its passage and approval bY th
