CITY QF NORTH QLM5TED <br />pRDINANCE N0. 86 - 7 <br />B Y : ig <br />? <br />, <br />AN ORDINANCE AUTHQRIZING THE SALE QF SIX <br />(6) BUSES QWNED BY THE CITY QF NORTH QLMSTED, <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, The Council and Administration have determined <br />that the buses set forth on Schedule A, owned by the City of <br />North plmsted and used to provide coordinated county wide <br />transit service, and <br />WHEREAS, the Greater Cleveland Regional firansit Authority <br />has replaced these vehicles with four (4) new buses funded by <br />federal and county taxes, and three (3) reconditioned/rebuilt <br />buses. <br />WHEREAS, It is the desire of this Council to sell these <br />surplus buses in accordance w?th administrative recommendation <br />and the applicable legal requirements. <br />NQW, THEREFpRE, BE IT QRDAINED BY THE CQUNCIL QF NpRTH <br />QLMSTED, CQUNfiY QF CUYAHQGA AND STATE QF OHIO: <br />SECTIqN l: That the following six (6) buses being used <br />for mass transportatian purposes are na longer needed, to wit: <br />See attached Schedule "A" made a part <br />hereaf as though fully rewritten herein. <br />SECTIQN 2: That the Service Director be and he is author- <br />ized to sell said buses in accardance with the law, provided <br />however, that the bid is approved by the Board of Control and <br />further provided that the bidder, shall, upon acceptance of <br />the bid, pay to the Directar of Finance of the City of North <br />Qlmsted, five percent (5/) of the bid price and that within five <br />(5) days thereafter, the entire bid price shall be paid and the <br />successful bidder shall accept and remave said property from the <br />premises of the City. <br />SECTIQN 3: That this Qrdinance is hereby declared to be <br />an emergency measure immediately necessary for the preservation <br />df the public health, safety and welfare and for the further <br />reason that the sale of surplus equipment is necessary to pro- <br />tect the value thereof for resale purposes, and to accept de- <br />livery of the above said replacement buses to provide county <br />wide transit service, and further provided it receives the <br />affirmative vote of two-thirds of all members elected to Council, <br />it shall take effect and be in force immediately upon its pass- <br />age and approval by the Mayor.
