<br />A <br />CITY OF NORTH QLM~STID <br />RESOLUTION N0. 87-133 <br />BY: MAYOR M. YVONNE PETRIGAC <br />A RESOLUTION URGING THE ELECTID REPRESENTATIVES OF THE <br />OHIO SENATE AND THE OHIO HOUSE OF REPRESENTATIVES TO <br />SUPPORT THE PASSAGE OF SENATE BILL 229 WHICH REVISES <br />SECTIONS OF THE OHIO REVZSID CODE TO ALLOW REGIONAL <br />COUNCIL OF GQUERI~ENI'S TO ESTABLISH UNDERCOVER <br />NARCOTICS UNITS AND RECOGNIZE NARCOTICS OFFICERS SO <br />EMPLOYID AS PEACE OFFICERS, AND DECLARING AN EMERGENCY. <br />WHERF,AS, the Westshore Enforcement Bureau Regional Council of Governments - <br />Narcotics Unit has tried various means of manning such unit since its inception <br />on April 1, 1972; and <br />WHEREAS, it has been determined that. the most effective means of manning <br />is the employment of undercover agents directly into the Unit by the Council <br />of Governments; and <br />WHEREAS, Attorney General Anthony Celebrezze ruled on October 3, 1986, that <br />such Narcotics Agents were not Undercover Drug Agents as defined by the statutes <br />of Ohio and could not, therefore, attend basic or advanced police training <br />schools and could not be empowered to arrest or to qualify for PERS in the manner <br />granted certain "peace officers"; and <br />WHEREAS, the Westshore Enforcement Bureau Regional Council of Governments - <br />Narcotics Unit has proven its effectiveness in combating drug activity and <br />related crimes; and <br />WHEREAS, the Council of the City of North Olmsted recognizes the need for <br />such undercover agents to be properly trained and covered by legislation in order <br />to operate effectively and efficiently; <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLMSTID, <br />STATE OF OHIO: <br />SECTION l: That the Council of the City of North Olmsted hereby expresses <br />its strong support of Senate Bill 229. which revises sections of the Ohio Revised <br />Code to allow Regional Council of Governments to establish Undercover Narcotics <br />Units and recognize Narcotics Officers as peace officers and is now pending in <br />the Ohio Senate Judiciary Corrmii.ttee and strongly urges its enactment at the <br />earliest possible time. <br />SECTION 2: That the Clerk of Council. is hereby directed to forward a <br />certified copy of this resolution to President of the Senate, Paul G. Gillmor, <br />State Senators Charles L. Butts, Gary C. Suhadolnik and Richard C. Pfeiffer, Jr., <br />State Representative Francine M. Panehal and Speaker of the House of Representa- <br />tives, Vernon G. Riffe. <br />
