ORDINANCE 87 - 112 BY: ~v,v~ AN ORDINANCE AUTHORIZING THE SALE OF SURPLUS PERSONAL PROPERTY OWNED BY THE CITY OF NORTH OLMSTED AND PREVIOUSLY USED BY THE DEPARTMENT OF PUBLIC SERVICE, THE SAFETY DEPARTMENT, AND THE RECREATION COMPLEX, AND DECLARING AN EMERGENCY, AS AMENDED. WHEREAS, the Council and the Administration have determined that various items of Personal Property owned by the City of North Olmsted and formerly used by the Department of Public Service, the Safety Department, and the Recreation Complex are no longer needed for municipal purposes, and WHEREAS, it is the desire of this Council to sell said Personal Property in accordance with Law. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION 1: That the following Personal Property was formerly used by the Department of Public Service , the Safety Department, or the Recreation Complex, and is no longer needed for municipal business, to wit: See attached Schedule "A" made a part hereof as though fully rewritten herein. SECTION 2: That the Mayor be and she is hereby authorized to sell said Personal Property to the highest bidder according to Law, provided however, that the highest bid is approved by the Board of Control and further provided that the highest bidder shall, upon acceptance of the bid, pay to the Director of Finance of the City of North Olmsted, twenty-five. percent (25%) of the bid price and that within five (5) days thereafter, the entire bid price shall be paid and the successful bidder shall accept and remove said property from the premises of the City. The Mayor, having been advised upon receipt of the full bid price, shall, if necessary, execute any and all documents required by Law. SECTION 3: That this Ordinance is hereby declared to be an emergency measure immediately necessary for the preservation of the Public Health, Safety and Welfare and for the further reason that the Sale of Surplus Equipment is necessary to protect the value thereof for resale purposes.
