~~~ , <br /> <br />~. <br />CITY OF NORTH OLMSTED <br />a~ya%~ ORDINANCE N0. 87- 109 <br />BY : ~ ~~r~~ 0 <br />U <br />AN ORDINANCE ACCEPTING AN EASEMENT FOR THE INSTALLATION <br />AND MAINTENANCE OF A WATER LINE FOR THE PURPOSE OF <br />CIRCULATING WATER SERVICE BY THE CITY OF CLEVELAND <br />THROUGH LAND OWNED BY WESTSIDE LAND COMPANY, SUNRISE <br />DEVELOPMENT COMPANY, MILTON A. WOLF AND HARLAN E. <br />SHERMAN, TRUSTEE, AND DECLARING AN EMERGENCY. <br />WHEREAS, Westside Land Company, Sunrise Development Co., Milton A. Wolf <br />and Harlan E. Sherman, Trustee, desire to extend a water main through their <br />property to circulate water to the North Olmsted Industrial Park; and <br />WHEREAS, The City of Cleveland requires that extension of water lines <br />shall only be approved if easements are granted to both the City of <br />Cleveland and to the City of North Olmsted in order that water mains may be <br />constructed and maintained therein; and <br />WHEREAS, this Council deems it in the best interest of the City of <br />North Olmsted to accept the easement described herein; attached Exhibit <br />nln <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That this Council does hereby accept an easement from <br />Westside Land Company, Sunrise Development Company, Milton A. Wolf <br />and Harlan E. Sherman, Trustee, for the installation and maintenance of a <br />water main for the purpose of circulating water service by the City of <br />Cleveland through the property of Westside Land Company, Sunrise <br />Development Company, Milton A. Wolf and Harlan E. Sherman, Trustee. <br />SECTION 2: That the Clerk of this Council is hereby authorized to <br />forward a certified copy of this Ordinance to the Director of Public <br />Utilities of the City of Cleveland. <br />SECTION 3: That it is found and determined that all formal actions of <br />this Council concerning and relating to the adoption of this Ordinance were <br />adopted in an open meeting of this Council, and that all deliberations of <br />this Council and of any of its committees that resulted in such formal <br />action, were in meetings open to the public in compliance with all legal <br />requirements, including Section 121.11 of the Ohio Revised Code. <br />1 <br />
