AN ORDINANCE AMENDING CHAPTER 533 OF THE CODIFIED ORDINANCES ENTITLED "OBSCENITY AND SEX OFFENSES BY ADDING THERETO A NEW SECTION N0. 533.15 ENTITLED "UNLAWFUL EXPOSURE BY WAITERS AND WAITRESSES AND ENTERTAINERS." WHEREAS, it has come to the attention of the administration that places of entertainment are sponsoring types of entertainment that may possibly affront the values of the community by having the main object of the entertainment appeal to puriant interests, and WHEREAS, it is the desire of the administration to amend the Codified Ordinances of the City of North Olmsted by prohibiting unlawful exposure by waiters, waitresses and entertainers. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION l: That Chapter 533 of the Codified Ordinances of the City of North Olmsted entitled "Obscenity and Sex Offenses" be amended to include therein anew Section 533.15, entitled "Unlawful Exposure by Waiters and Waitresses and Entertainers", which new Section shall read as follows: "533.15 UNLAWFUL EXPOSURE BY WAITERS, WAITRESSES, AND ENTERTAINERS. No person who, while acting as a waiter, waitress, entertainer or employee, in an establishment which serves food, beverages, or food and beverages, including but not limited to alcoholic beverages, for consumption on the premises of the establishment shall: (a) Expose his or her genitals, pubic hair, buttocks, perineum, anal region or pubic hair region; or (b) Expose any device, costume or covering which gives the appearance of or simulates the genitals, pubic hair, buttocks, perineum, anal region or pubic hair region; or (c) Exposes any portion of the female breast at or below the areola thereof.
