:I~.rv.. . ~, ... <br />~ t <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 87 - 43 <br />BY: MAYOR PETRIGAC <br />AN ORDINANCE ESTABLISHING A POLICY OF CONTINUATION OF <br />HOSPITALIZATION BENEFITS FOR EMPLOYEES AND DEPENDENTS <br />OF EMPLOYEES UNDER CERTAIN CIRCUMSTANCES, AS AMENDED. <br />WHEREAS, the Congress of the United States enacted the Comprehensive <br />Omnibus Budget Reform Act hereinafter referred to as "Cobra", which Act <br />provided that under certain circumstances employers were required to offer <br />to terminated employees or the dependents of deceased employees as well as <br />other non-qualifying dependents, extended hospital coverage beyond the <br />coverage permitted under the policy of the employer; and <br />WHEREAS, the City. of North Olmsted does comply with the requirements of <br />Cobra and wishes to provide an additional one months' coverage which is <br />currently not provided by Cobra, for the following individuals: <br />1) A covered, widowed spouse and/or dependent child up to age 23 <br />of an employee; <br />2) A covered employee who is disqualif ied from coverage due to a <br />reduction in hours of work; <br />3) A covered employee who is not qualified for coverage. due to <br />involuntary. termination or layoff, except that no coverage <br />will be provided when .the involuntary termination is due as <br />a result of gross misconduct; and <br />WHEREAS, the Council has considered the policy as aforesaid and agrees <br />with the same. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, <br />COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That there is hereby established a hospitalization policy <br />with respect to continuing to pay for coverage of certain hospitalization <br />benefits for employees and/or their dependent spouses or children for a one <br />month period under the following circumstances: <br />1) A covered, widowed spouse and/or dependent child up to age 23 <br />of an employee; <br />2) A covered employee who is disqualified from coverage due to a <br />reduction in hours of work; <br />
