CITY OF NORTH OLMSTED <br />ORDINANCE N0. 87 - 5 <br />BY: Ronald J. Tallon <br />AN ORDINANCE ACCEPTING AN EASEMENT FROM RONALD WAGNER FOR <br />STORM SEWERS LOCATED IN LORAIN ROAD, PERMANENT PARCEL NOS. <br />234-10-51 and 234-10-52, WITHIN THE CITY OF NORTH OLMSTED, <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, a storm sewer extension has been incorporated within <br />the design and construction of Ron's North Olmsted Beverage Drive- <br />Thru and Video Store, and <br />WHEREAS, The City Engineer has advised the Council that it is in <br />the best interest of the City of North Olmsted to accept an easement <br />with respect to the storm drainage system, and <br />WHEREAS, it is the desire of the City of North Olmsted and said <br />Ronald Wagner to have the City's rights in said storm drainage system <br />clearly specified and made a matter of record by recording a formal <br />easement, and <br />WHEREAS, this Council deems it to be in the best interest of the <br />City of North Olmsted to accept said easement. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That this Council does hereby accept an easement from <br />Ronald Wagner for the construction and maintenance of a storm drainage <br />system under and on the property described in said easement, which is <br />attached hereto and marked Exhibit "A", and made a part hereof as though <br />fully rewritten herein. <br />SECTION 2: That the Engineer of the City of North Olmsted is <br />hereby directed to cause said easement to be recorded in the Office <br />of the Recorder of Cuyahoga County. <br />SECTION 3: That this ordinance is hereby declared to be an <br />emergency measure immediately necessary for the preservation of the <br />public health, safety and welfare, and for the further reason that it <br />is necessary to assure proper rights of access for maintenance of <br />storm sewers on the site, and further, provided it receives the <br />affirmative vote of two-thirds of all members elected to Council, <br />it shall take effect and be in force immediately upon its passage <br />and approval by the Mayor. <br />
