CITY OF NORTH OLMSTED ORDINANCE N0. 88-119 BY: Councilman Wilamosky AN ORDINANCE VACATING A OKE FOOT PORTIOK OF CYPRE3S DRIVE AND A ONE FOOT PORTION OF MAPLEHURST ROAD WHERE THE SAME ABUT THE OLl1STED TOWNSHIP CORPORATION LIKE. WHEREAS, the CitY Couttcil has been made aware recently that the area of land in Olmsted Township which is to the South of the stub end of Maplehurst Road and the area of land in Olmsted Townshig which is to the South of the stub end of Cypress Drive is progosed to be developed for hiqh density multi family use; and WHEREAS, in order to maintain the single family residential inteqrity of the Olmsted Colany Subdivision this Council believes it necessary to restrict access to the subdivision from Olmsted Township by vacating a portian of Cypress Drive and a portion of Maplehurst Road; and WHEREAS, it has been determined by this Council that said roadway is no longer suitable for public use; and WHEREAS, pursuant to Ohio Revised Code Section 723.05, Council may, on it is aWn authority, for good cause shoWn, vacate any street or portion thereof; and WHEREAS, the Planning Comtnission on the 25th day of October , 1988, approved the vacatinq of a portion of Cpgress Drive and a portion of Maplehurst Road as aforesaid, findiag that it no longer was needed for street purposes; and WHEREAS, Council, upon hearinq, is satisfied there is cause for such vacation, and that it will not be detrimental to the general interest and ouqht to be made. NOW, THEREFORE, BE IT ORDAINED BY TIiE COUNCIL OF TIiE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SBCTION 1: That a one foot portion of the southern end of Cypress Drive where it abuts the Olmsted Toxnship Corporation Line be and the same is hereby vacated and that the leqal description for said vacated portion of Cygress Drive is described more fully in Exhibit "A" which is attached hereto and made a part hereof.
