..3 ? ? <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 88 - 103 <br />By ; ?. . <br />AN ORDINANCE AUTHORIZING THE DIRECTOR OF LAW FOR AND ON <br />BEHALF OF THE CITY OF NORTH OLMSTED TO APPROVE AND SIGN <br />A FINAL JUDGMENT ENTRY IN THE CASE OF DEVELOPERS <br />DIVERSIFIED, ET AL V. THE CITY OF NORTH OLMSTED, ET AL., <br />IN THE COURT OF COMMON PLEAS, CUYAHOGA COUNTY, CASE N0. <br />127076, AND DECLARING AN EMERGENCY. <br />WHEREAS, this Council and the administration, after having conferred with <br />the Director of Law as well as an expert planner hired by the City to <br />represent the City's position in the aforesaid court case and the property <br />owners involved, have determined, that it is in the best interests of the <br />City to settle the case of Developers Diversified, et al. v. The City of <br />North Olmsted, et al., Court of Common Pleas, Cuyahoga County, Ohio, Case <br />No. 127076, ;and <br />WHEREAS, The basis of settlement is specified in the attached Judgment <br />Entry which includes among other things, the establishment of four separate <br />parcels to be used for multi-family, office building, hotel, and office <br />building/hotel, all of which is more fully specified in said Judgment <br />Entry; and <br />WHEREAS, after the Council conferred with the Law Director, Robert <br />Hill--City Planner, the members of the Planning Commission, and the <br />administration, this Council believes that it would be consistent with the <br />public health, safety, and welfare of the City of North Olmsted to adopt a <br />Judgment Entry which permits the uses as specified in said Judgment Entry. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />Section l: That the Director of Law of The City of North Olmsted be <br />and he is hereby directed to sign on behalf of The City of North Olmsted <br />the proposed Judgment Entry which is attached hereto and made a part hereof <br />and marked Exhibit "A" together with exhibits attached to the Judgment <br />Entry, and that upon the signing of same, that it be presented to the Court <br />of Common Pleas for the signature of the Judge. <br />Section 2: That this Ordinance is declared to be an emergency measure
