r ` <br /> <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 88- 98 <br />BY: MR., TALLON <br />AN ORDINANCE AUTHORIZING THE DIRECTOR OF LAW FOR THE <br />CITY OF NORTH OLMSTED TO APPROVE AND SIGN ON BEHALF OF <br />THE CITY OF NORTH OLMSTED A FINAL JUDGMENT SETTLIIMENT <br />ENTRY IN THE CASE OF ROMP REALTY V. CITY OF NORTH <br />OLMSTED, COURT OF COMMON PLEAS, CUYAHOGA COUNTY, CASE <br />N0. 69188, AND DECLARING AN EMERGENCY. <br />WHEREAS, Romp Realty previously had filed an application with the City <br />of North Olmsted for the rezoning of a certain portion of land owned by <br />Romp Realty in the area of Columbia Road and Lorain Road, immediately <br />behind and adjacent to the property that is currently used as Danny Boy's <br />Farm Market; and <br />WHEREAS, the City of North Olmsted refused to grant such change in <br />zoning; and <br />WHEREAS, the Plaintiff Romp Realty pursued the rezoning request and was <br />eventually successful before the Court of Common Pleas; and <br />WHEREAS, the City of North Olmsted appealed said decision to the Court <br />of Appeals, Eighth Appellate District, which court sustained the lower <br />court; and <br />WHEREAS, the City of North Olmsted filed an application with the <br />Supreme Court of the State of Ohio to have the court certify the record to <br />the Supreme Court which request was unsuccessful; and <br />WHEREAS, the Court of Common Pleas decision is final and binding; and <br />WHEREAS, the Court of Common Pleas in this judgment entry gave the City <br />of North Olmsted sixty days within which to appropriately zone the <br />property; and <br />WHEREAS, by agreement of counsel for Plaintiff, as well as counsel for <br />the City, subject to approval of the City Council, an agreement has been <br />reached whereby certain improvements can be made on the land which are <br />consistent with the plan that is attached to the Judgment Entry; and <br />WHEREAS, the City Council for the City of North Olmsted is in agreement <br />with the settlement.
