affects the public health, safety or welfare, or, with respect to the <br />aesthetics of the proposal, it will have a probable negative effect upon <br />the market value of properties surrounding it within the same zoning <br />district. <br />(c) Authority of Commission to Change Proposal. <br />If the Planning Commission determines that a proposal will have a <br />significant adverse impact upon either residential, commercial or other <br />neighbors, vehicular or pedestrian safety, or aesthetically upon the <br />community, it shall make such changes, and only such changes, in the <br />proposal which will, if practicable, eliminate the significant adverse <br />impact, and, if such a change is not practicable, then such changes which <br />will ameliorate the adverse impact to the fullest extent practicable. <br />(d) Public In ut• Advice of Other Officials and Bodies. <br />In making its determinations and proposed changes pursuant to this <br />section, the Planning Commission shall receive complaints, comments and <br />recommendations from the public. Prior to making its determinations and <br />proposed changes, the Commission shall further refer the proposal to the <br />Architectural Review Board, the Forester, the Safety Departments, and any <br />other City officials, board, or commission, whose advice and <br />recommendations may, in the opinion of the Commission, assist the <br />Commission in fulfilling its duties herein. <br />(e) Time for Review. The Planning Commission shall, within 60 days of <br />its first review of a proposal, make its determinations and changes, if any <br />are required, unless this period of time is extended, either with the <br />consent of the applicant or because of delay attributable to the applicant. <br />1126.05 REFERRAL BY PLANNING COMMISSION TO COUNCIL, <br />All applications for building permits, following Planning Commissions <br />review and the making of its determinations and proposed changes as <br />authorized by this Chapter, shall be forwarded to the Building, Zoning, and <br />Development (BZD) Committee of Council and then to Council as a whole for <br />final approval or rejection. The Planning Commission shall in writing <br />provide the BZD and Council with its determinations of significant adverse <br />impact and any changes to the proposal which address, and either eliminate <br />or ameliorate, the significant adverse impact found by the Commission. If <br />the application is approved by a majority of the members elected to <br />Council, and if the applicant meets all other applicable conditions under <br />local and state law, the Building Official shall issue the applicant a <br />building permit. <br />1126.06 PROCEDURE FOR "MINOR CHANGES." <br />4
