<br />? <br />? <br />The Grantors hereby reserve the right to use said premises within the <br />limits of the above described easement for the passage or transportation <br />of personnel, materials or equipment over or across the described easement <br />and to make such other use of said premises within the limits of the above <br />described easement as are not herein expressly prohibited by and are not <br />inconsistent with the right and easement hereby granted. <br />The Grantors further agree that the City of North Olmsted shall be <br />relieved of all liability to the Grantors on account of the maintenance, <br />construction, reconstruction or relocation of said sewers and said <br />Grantors hereby indemnify and guarantee to save harmless the City of North <br />Olmsted against any expense or damage to said sewers and appurtenances, <br />that said Grantors, their successors or assigns may at any time cause b3- <br />the construction or maintenance of any paving, walks, switeh-tracks, <br />tunnels, sewers, ducts, pipe or pole lines within or over said easement, <br />or such other use of premises within the rights of above described <br />easement as are not expressly prohibited herein, under the same conditions <br />that legally exist for the installation and maintenance of sewers and <br />appurtenances in streets dedicated to public use. <br />TO HAVE AND TO HOLD the above granted easements, right-of-way, storm sewer <br />sewers and appurtenances and further additions installed by Grantors to <br />said sewers and appurtenances in, over and subjacent to the above <br />described premises, for the purpose above mentioned unto said Grantee, the <br />City of North Olmsted, forever. <br />It is the intent of this conveyance that neither the filing of this deed <br />or conveyance, its acceptance by the Grantee, nor any other circumstances <br />shall be construed as a dedication of the premises herein described for <br />public use as a street. <br />And the Grantors do for themselves, their successors and assigns covenant <br />with the said Grantee and its successors, that at and until the sealing of <br />these presents, it is well seized of the above described premises as a <br />good and indefeasible estate in FEE SIMPLE and has good right to bargain <br />and grant the same manner and forms as above written, and that it will <br />WARRANT AND DEFEND said premises with appurtenances thereunto belonging to <br />the Grantee, its successors and assigns against all lawful claims and <br />demands whatsoever for the purpose herein desribed. <br />It is agreed that wherever a party is named in this instrument there shall <br />be intended and included, in each case, that party, his or her heirs, <br />administrators, their successors and/or assigns. <br />Signed and acknowledged in the presence of: <br />7515 COMPANY <br />B y : P" OA &1? 4-0 <br />R.A.G.
