CITY OF NORTH OLMSTED ORDINANCE N0. 88-78 BY: Councilman Ronald Wilamosky ? ,?,? 3! ? q a I AN ORDINANCE CREATING NEW AND REVISED SECTION 1161.07 OF THE NORTH OLMSTED ZONING CODE, ENTITLED PARKING AND STORING OF COMMERCIAL TRACTORS IN RESIDENTIAL DISTRICTS PROHIBITED", AS AMENDED. WHEREAS, in enforcing existing Section 1161.07 of the Zoning Code of the North Olmsted Zoning Code, entitled "Parking Trucks in Residents Districts," a question has arisen in the courts as to what types of trucks are prohibited within the scope of this legislation; and WHEREAS, it is the desire of this Council to more clearly define its intentions and the nature of vehicles which are not permitted to be parked in residents districts, for health and safety reasons; WHEREAS, afte¢r a careful considerationa th?e,O7lanning Commission of the City, on the ? day of , 1988 y?Pecommendol approval of the change of the district herein pecified. NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That there be and hereby is created new and revised Section 1161.07 of the North Olmsted Zoning Code, entitled "Parking and Storing of Commercial Tractors in Residential Districts Prohibited," which as created shall read as follows: 111161.07 Parkin and Storing of Commercial Tractors in Residential Districts Prohibited. (a) No commercial tractor shall be stored or parked upon any property located within an A, B, C, or Two-Family Residence District. (b) For purposes of this Section, "Commercial Tractor" shall be construed to mean any motor vehicle having motive power designed or used for drawing other motor vehicles, or designed or used for drawing another motor vehicle while carrying a portion of such other motor vehicle or its load, or both.
