YVONNE PETRIGAC AND COUNCIL <br />AN ORDINANCE DETERMINING TO PROCEED WITH THE IMPROVEMENT <br />OF NORTH OLMSTED INDUSTRIAL PARKWAY BETWEEN CERTAIN <br />TERMINI BY GRADING, DRAINING, CURBING, PAVING AND <br />CONSTRUCTING A WATER MAIN AND STORM AND SANITARY SEWERS, <br />TOGETHER WITH THE NECESSARY APPURTENANCES THERETO, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, this Council has adopted Resolution No. 88-68 on June , <br />1988, declaring the necessity of making the improvement described in Sect on <br />1; <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North <br />Olmsted, Cuyahoga County, Ohio, that: <br />Section 1. It is determined to proceed with the improvement of North <br />Olmsted Industrial Parkway from Lorain Road southeasterly approximately 556 <br />feet, thence easterly approximately 1699 feet to its terminus by grading, <br />draining, curbing, paving and constructing a water main and storm sewers; by <br />constructing sanitary sewers in that Parkway and in easements of the City <br />fifteen feet wide running parallel with and contiguous to each side of that <br />Parkway; and by constructing a water main in an easement of the City thirty <br />feet wide running from a point in that Parkway approximately 945 feet from the <br />centerline of Lorain Road southerly approximately 465 feet, thence easterly <br />approximately 384 feet to an existing water main; in each case together with <br />the necessary appurtenances thereto. <br />Section 2. The improvement shall be made in accordance with the <br />provisions of Resolution No. 88-68, and with the plans, specifications, <br />profiles and estimate of cost previously approved and now on file in the <br />office of the Clerk of Council. <br />Section 3. All claims for damages resulting from the improvement <br />that have been legally filed shall be inquired into after completion of the <br />improvement, and the Director of Law is authorized and directed to institute <br />legal proceedings in a court of competent jurisdiction to inquire into those <br />claims. <br />Section 4. The portion of the cost of the improvement to be assessed <br />in accordance with Resolution No. 88-68 shall be assessed in the manner and <br />the number of installments provided, and on the lots and lands described, in <br />that resolution. <br />Section 5. The estimated special assessments previously prepared and <br />filed in the office of the Clerk of Council by Alex Kanareff & Associates are <br />adopted. <br />Section 6. The Clerk of Council shall deliver a certified copy of <br />this ordinance to the County Auditor within 15 days after its passage. <br />Section 7. Unless the property owners to be assessed have cancelled <br />their obligations under the petition for the improvement by written notice to <br />this Council within 15 days after the City has provided notice to those <br />property owners that the lowest and best bid for the improvement exceeds by <br />10Y or more the estimated cost filed in the office of the Clerk of Council all <br />as provided in the petition for the improvement filed in the office of the
