RESOLUTION N0. 88-68 <br />Councilman Wilamosky on behalf of the <br />BY: MAYOR M. YVONNE PETRIGAC AND COUNCIL <br />A RESOLUTION DECLARING IT NECESSARY TO IMPROVE NORTH OLMSTED <br />INDUSTRIAL PARKWAY BETWEEN CERTAIN TERMINI BY GRADING, <br />DRAINING, CURBING, PAVING AND CONSTRUCTING A WATER MAIN AND <br />STORM AND SANITARY SEWERS, TOGETHER WITH THE NECESSARY <br />APPURTENANCES THERETO, AND DECLARING AN EMERGENCY. <br />WHEREAS, the owners of 100% of the area to be assessed for the <br />improvement described in Section 1 have petitioned this Council for the <br />improvement, which petition has heretofore been accepted by this Council; and <br />WHEREAS, Council has previously authorized and requested Alex <br />Kanareff & Associates, an engineering consultant to the City, to prepare plans <br />and specifications for the improvement described in Section 1; <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of North <br />Olmsted, Cuyahoga County, Ohio, three-fourths of all members elected or <br />appointed thereto concurring, that: <br />Section 1. It is declared necessary to improve North Olmsted <br />Industrial Parkway from Lorain Road southeasterly approximately 556 feet, <br />thence easterly approximately 1699 feet to its terminus by grading, draining, <br />curbing, paving and constructing a water main and storm sewers; by <br />constructing sanitary sewers in that Parkway and in easements of the City <br />fifteen feet wide running parallel with and contiguous to each side of that <br />Parkway; and by constructing a water main in an easement of the City thirty <br />feet wide running from a point in that Parkway approximately 945 feet from the <br />centerline of Lorain Road southerly approximately 465 feet, thence easterly <br />approximately 384 feet to an existing water main; in each case together with <br />the necessary appurtenances thereto. <br />Section 2. The plans, specifications, profiles and estimate of cost <br />of the improvement, prepared by Alex Ranareff & Associates, and now on file in <br />the office of the Clerk of Council, are approved. The improvement shall be <br />made in accordance with, and the grade of the improvement and of any street <br />shall be the grade as shown on, the plans, specifications and profiles for the <br />improvement. <br />Section 3. This Council finds and determines that (i) the improve- <br />ment is conducive to the public health, convenience and welfare of this City <br />and the inhabitants thereof and (ii) the lots and lands to be assessed as <br />described in Section 4 hereof are specially benefited by the improvement. <br />This Council further finds and determines that the improvement has been <br />petitioned for by the owners of 100% of the area to be assessed for the <br />improvement. <br />Section 4. The whole cost of the improvement shall be assessed in <br />proportion to the benefits that may result from the improvement upon the <br />following lots and lands of the petitioners, being 100% of the area to be <br />assessed for the improvement:
