_, .,??•-, <br />j f <br />P E TI T I 0 N <br />City of North Olmsted, Ohio <br />June 9, 1988 <br />To the Council of the City of North Olmsted, Ohio: <br />We are owners of the respective properties set forth opposite our <br />names below, comprising 100% of the area to be assessed for the improvement <br />described below. We respectfully petition the Council for the improvement of <br />a new street in the City, running southeasterly from Lorain Road approximately <br />556 feet, thence easterly approximately 1699 feet to its terminus, designated <br />North Olmsted Industrial Parkway, by grading, draining, curbing, paving and <br />constructing a water main and storm sewers; by constructing sanitary sewers in <br />that Parkway and in easements of the City fifteen feet wide running parallel <br />with and contiguous to each side of that Parkway; and by constructing a water <br />main in an easement of the City thirty feet wide running from a point in that <br />Parkway approximately 945 feet from the centerline of Lorain Road southerly <br />approximately 465 feet, thence easterly approximately 384 feet to an existing <br />water main; in each case together with the necessary appurtenances thereto <br />(the Improvement). We request that the total cost of the Improvement be <br />assessed in proportion to the benefits that will result from the Improvement <br />as set forth below in twenty annual installments upon our lots and lands <br />described below bounding and abutting on the Improvement. <br />In connection with this petition and in furtherance of the purposes <br />hereof, we acknowledge that we have reviewed or have caused to be reviewed (i) <br />the plans for the Improvement, (ii) the preliminary estimate of cost of the <br />Improvement heretofore prepared by Alex Kanareff & Associates, Westlake, Ohio, <br />engineering consultant to the City, a copy of which preliminary estimate of <br />cost is attached hereto, and (iii) the assembly plat of a portion of North <br />Olmsted Industrial Park filed for record on April 15, 1988 in Volume 241 at <br />page 78 of the Plat Records in the office of the Recorder of Cuyahoga County <br />and an assembly plat of the remaining portion of North Olmsted Industrial Park <br />prepared by Alex Kanareff & Associates and presented to Cauncil concurrently <br />with this petition. We, individually and collectively, agree to pay all costs <br />heretofore or hereafter incurred by the City pursuant to this petition in the <br />event that, for any reason, the Improvement is not made and the cost of the <br />Improvement is not assessed against the specially benefited properties as <br />requested herein. <br />In consideration of the Improvement, we, individually and collec- <br />tively, (i) agree to pay promptly all special assessments levied against our <br />properties as they become due, and that the determination by the Council of <br />the special assessment against our lots and lands will be final, conclusive <br />and binding upon us or upon all transferees of our properties; (ii) acknowl- <br />edge and agree that no other property will receive special benefits from the <br />Improvement and request that the amount that would have been assessed on any <br />such other property, except for the absence of any special benefit to any such <br />other property, be assessed upon our properties; (iii) submit and agree that <br />the special benefits that will result from the Improvement will inure to our <br />respective properties in the proportions set forth below and request that the
