1331.11 ADMINISTRATIVE LIABILITY. <br />No officer, agent or employee of the City shall render himself <br />personally liable for any damage that may accrue to person or property as a <br />result of any act required or permitted in the discharge of his duties <br />under this chapter. Any suit brought against any officer, agent, or <br />employee of the City as a result of any act required or permitted in the <br />discharge of his duties under this chapter shall be defended by the Law <br />Director, until the final determination of the proceedings therein. <br />1331.12 SEPARABILITY. <br />It is the intention of Council that each separate provision of this <br />chapter shall be deemed independent of all other provisions herein, and it <br />is further the intention of Council that if any provision of this chapter <br />be declared invalid, all other provisions hereof shall remain valid and <br />enforceable. <br />1331.13 AUTHORITY OF BUILDING COMIIMISSIONER TO EXAMINE PREMISES. <br />The Building Commissioner or a person delegated by him shall be <br />empowered to examine or cause to be examined any building or dwelling <br />within the City to determine whether such building or dwelling is <br />dangerous, unsafe or constitutes a nuisance, as provided by this chapter. <br />1331.99 PENALTIES. <br />(a) The owner of any dangerous building who fails to comply with any <br />notice or order to repair, vacate or demolish such building, given by any <br />person authorized by this chapter to give such notice or order, is guilty <br />of a misdemeanor of the fourth degree for each offense and shall be fined <br />ten dollars ($10.00) for each day such f ailure to comply continues beyond <br />the date fixed for compliance. <br />(b) The occupant or lessee in possession who fails to comply with any <br />notice to vacate and who fails to repair such building in accordance with <br />any notice given, as provided in this chapter, is guilty of a misdemeanor <br />of the fourth degree and shall be fined ten dollars ($10.00) for each day <br />such f ailure to comply continues beyond the date fixed for compliance. <br />(c) Any person removing the notice provided in Section 1331.04(f) is <br />guilty of a misdemeanor of the fourth degree for each offense. <br />SECTION 2: That the enacement of this ordinance does hereby repeal <br />Ordinance 68-200 as well as any ordinance or part of an ordinance <br />inconsistent herewith. <br />SECTION 3: That this ordinance is hereby declared to be an emergency <br />measure immediately necessary for the preservation of the public health, <br />9
