c <br />_. * .. . <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 88-60 <br />BY: MAYOR PETRIGAC AND THE ENTIRE COUNCIL <br />AN ORDINANCE TO AMEND SECTIONS 1101.02, 1101.03, 1101.04, <br />1101.05, 1101.06 AND 1101.10 OF THE CODIFIED ORDINANCES OF <br />THE CITY OF NORTH OLMSTED, OHIO, AND TO ENACT SECTION <br />1101.11 OF THOSE CODIFIED ORDINANCES, ALL TO PROVIDE THAT, <br />IN LIEU OF INSTALLING ALL IMPROVEMENTS OR POSTING PER- <br />FORMANCE AND MAINTENANCE BONDS REQUIRED IN CONNECTION WITH <br />THE ACCEPTANCE OF A FINAL PLAT, A DEVELOPER MAY PETITION <br />COUNCIL FOR THE CONSTRUCTION OF SUCH ZMPROVEMENTS AND THE <br />LEVYING OF SPECIAL ASSESSMENTS TO PAY THE COSTS THEREOF, <br />AND TO DECLARE AN EMERGENCY, AS AMENDED, <br />WHEREAS, notice of a public hearing on the question of the amendments <br />of existing provisions and enactment of new provisions provided for herein was <br />published twice in a newspaper of general circulation in the City of North <br />Olmsted, with the first publication being at least fifteen days prior to the <br />public hearing and the public hearing was held on June 7, 1988, and it is <br />hereby determined that Section 711.101 of the Ohio Revised Code has been fully <br />complied with; <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North <br />Olmsted, Cuyahoga County, Ohio, that: <br />Section 1. It is necessary to amend Sections 1101.02, 1101.03, <br />1101.04, 1101.05, 1101.06 and 1101.10 of the Codified Ordinances of the City <br />of North Olmsted, Ohio and to enact Section 1101.11 of the Codified Ordinances <br />of the City of North Olmsted, Ohio, all as provided in Sections 2 through 8 <br />hereof, in order to provide that, in lieu of installing all improvements or <br />posting performance and maintenance bonds required in connection with the <br />acceptance of a final plat, a developer may petition Council for the con- <br />struction of such improvements and the levying of special assessments to pay <br />the costs thereof. <br />Section 2. Section 1101.02 of the Codified Ordinances of the City of <br />North Olmsted, Ohio, as established by Ordinance No. 79-139, passed December <br />2, 1980, as amended by Ordinance No. 84-125, passed January 16, 1985, is <br />hereby amended to read as follows: <br />"1101.02 MAJOR SUBDIVISIONS; PROCEDURAL REQUIREMENTS. <br />(a) Any developer who desires to present a major <br />subdivision to the City shall make application to the City <br />Engineer. The City Engineer shall supply the developer <br />with all the rules and regulations of the Planning Com- <br />mission, as well as any pertinent ordinances dealing with <br />the subdivision or land. Any person submitting a proposed <br />subdivision shall submit with his application a preliminary <br />plan and location map, a topographic map, a plat, improve- <br />ment plans (unless the developer intends to submit a <br />petition described in Section 1101.11 for acceptance by <br />Council) and other necessary documents, such as easements <br />and title insurance documents. <br />(b) A preliminary plan and location map shall show <br />the type of zoning of areas contiguous to the land to be <br />platted. Such preliminary plan and location map shall <br />contain the following information:
