? <br />(B) Be signed by the developer and each owner <br />of each parcel or lot of property to be <br />assessed for the improvements and, to the <br />extent known, by the prospective owners of <br />each such parcel or lot of property; <br />(C) Waive the procedural requirements of Chapter <br />727 of the Ohio Revised Code and all resolu- <br />tions, ordinances, hearings and notices for <br />the making of such improvements and the <br />levying of special assessments to pay costs <br />thereof; <br />(D) Set forth what portion, if any, of the cost <br />of the improvements the City will assume; <br />(E) State whether the improvements are to be <br />installed all at once or, with the approval <br />of the City Engineer and the Planning Com- <br />mission, whether portions of the improve- <br />ments may be installed as determined by the <br />City Engineer and Planning Commission to be <br />desirable; and <br />(F) Contain such other provisions as counsel for <br />the City may determine to be appropriate for <br />the proper safeguarding of the City's inter- <br />ests. <br />_ If any such petition is accepted by Council, the fact <br />of such acceptance shall be noted on the final plat prior <br />to its recording." <br />Section 9. Sections 1101.02, 1101.03, 1101.04, 1101.05, 1101.06 and <br />1101.10 of the Codified Ordinances of the City of North Olmsted, Ohio, as <br />established by Ordinance No. 79-139, passed December 2, 1980, as amended by <br />Ordinance No. 83-77, passed July 19, 1983, by Ordinance No. 84-38, passed May <br />15, 1984, and by Ordinance No. 84-125, passed January 16, 1985, as those <br />Sections have heretofore existed, are hereby repealed. <br />Section 10. It is found and determined that all formal actions of <br />this Council concerning and relating to the passage of this ordinance were <br />taken in an open meeting of this Council, and that all deliberations of this <br />Council and of any of its committees that resulted in such formal action, were <br />in meetings open to the public in compliance with the law. <br />Section 11. This ordinance is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public peace, health, <br />safety and welfare of the City and for the further reason that this ordinance <br />must be immediately effective to remove unnecessary restrictions that will <br />adversely affect the proper and effective development of the City of North <br />Olmsted; wherefore, this ordinance shall be in full force and effect immedi- <br />ately upon its passage and approval by the Mayor. <br />Passed 1988 <br />? <br />Attest: <br />Clerk of Council <br />Approved: 1988 <br />0 <br />Mayor <br />- 12 - <br />President of Council
