CITY OF NORTH OLMSTED <br />ORDINANCE N0. 88- 34 <br />BY: RON TALLON <br />AN ORDINANCE AMENDING SECTION 1139.08 OF THE NORTH <br />OLMSTED ZONING CODE, ENTITLED "ACCESS LOCATED WITHIN <br />DISTRICT". <br />WHEREAS, this Council desires, in order to further protect the health, <br />welfare and safety of its residents, to require that all access drives to <br />retail buildings and uses be located entirelq within retail districts; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Section 1139.08 of the Zoning Code entitled "Access <br />located within District" and which presently reads: <br />"All driveways, roadways and sidewalks used or <br />intended for use as access to buildings or uses in a <br />Retail Business District shall be located in their <br />entirety within the area zoned for a Retail Business <br />District," <br />Shall be amended, and as amended, shall read as follows: <br />"All driveways, drives, roadways and sidewalks used or <br />intended for use as access to buildings or uses in a <br />Retail Business District, or for any other use or <br />purpose, including access for Fire Department vehicles <br />and apparafius, shall be located in their entirety within <br />the area zoned for a Retail Business District." <br />SECTION 2; That any other ordinance or parts of ordinances or <br />resolutions or parts of resolutions in conflict herewith are hereby <br />repealed. <br />SECTION 3: That the Clerk of this Council be and she is herebp <br />directed to cause a Notice of a Public Hearing hereon to be given pur,suant <br />to the provisions of Section 14 of Article IV of the Charter of this City, <br />the Zoning Code of the City of North Olmsted shall be amended as specified <br />in Section 1 hereof. <br />SEC_ TION 4: That after submission of this Ordinance to the Planning <br />Commission of the City for its opinion and recommendation, and after public <br />hearing as specified in Section 3 hereon, and after its passage pursuant to <br />the Charter of this City, the Zoning Code of the City of North Olmsted <br />shall be amended as specified in Section 1 hereof. <br />1
