CITY OF NORTH OLMSTED <br />ORDINANCE N0. 88-30 <br />BY: Ronald Tallon <br />AN ORDINANCE GRANTING THE EXTINGUISHMENT AND RELEASE <br />OF A UTILITY EASEMENT GRANTED TO THE CITY OF NORTH <br />OLMSTED AND RECORDED IN VOLUME 238, PAGE 65, OF <br />CUYAHOGA COUNTY PLAT RECORD, AND TO FURTHER ACCEPT A <br />NEW EASEPIENT IN PLACE THERE OF, FOR THE INSTALLATION <br />AND MAINTENANCE OF SEWERS FOR THE PURPOSE OF SUPPLYING <br />SEWER SERVICE TO HASTIfdGS DRIVE PROPERTIES. <br />WHEREAS, this Council previously accepted an easement on <br />private property for the supplying of sewer service to Hastings <br />Drive properties, and <br />WHEREAS, it has been determined that the easement <br />heretofore established is no longer appropriate because of its <br />effect on the development of said property and it is the desire <br />of the owners, together with the recommendation from the Planning <br />Commission to have an alternate easement established for the <br />supplying of sewer service to the subject private property, <br />which is more fully set out on the plat of Utility Easement and <br />Easement Vacation for Timothy Quinn and Curtis L. Dunlap, which <br />is dated January 15, 1988 (Revised). <br />NOW, THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That this Council does hereby vacate the utility <br />easement that is more specifically set out in Volume 238, Page 65, <br />of Cuyhoga Count,y Plat Records, which is more specifically <br />designated on the plat of Utility Easement and Easement Vacation <br />for Timothy Quinn and Curtis L. Dunlap, dated January 15, 1988 <br />(Revised), in yellow shade, which plat is attached hereto and <br />made a part hereof and marked Exhibit "A". <br />SECTION 2: That this Council does hereby accept an <br />easement from Timothy Quinn and Curtis L. Dunlap for the <br />installation and maintenance of a sewer for the purpose of <br />supplying sewer service by the City of North Olmsted to the <br />Hastings Drive properties which is more fully set out on <br />Exhibit "A", which is attached hereto and made a part hereof, <br />and fur.ther said easement is more fully delineated on Exhibit "A" <br />and marked in yellow shade.
