K <br />. <br />t <br />t <br />CITY OF NORTH OLh1STED <br />ORDINANCE NO. 88-29 <br />BY: Ronald Tallon <br />AN ORDINANCE GRANTING THE EXTINGUISHMENT AND RELEASE <br />OF A SEWER EASEMENT GRANTED TO THE CITY OF NORTH <br />OLMSTED AND RECORDED IN VOLUME 11663, PAGE 681, OF <br />CUYAHOGA COUNTY PLAT RECORDS, AND DECLARING AND <br />EMERGENCY. <br />WHEREAS, the City of North Olmsted previously was granted <br />an easement on private property owned by Charles B. and <br />Wilma B. Lewis for the purpose of installation and maintenance <br />of a sanitary sewer, and <br />WHEREAS, it has been determined that the easement heretofore <br />established, is no longer appropriate because the intended sewer <br />was constructed at an alternate location. <br />N04J, THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF fJORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTIOIV 1: That this Council does hereby vacate the sewer <br />easement that is more specificalld set out in Volume 11663, <br />Page 681, of Cuyahoga County Plat Records, which is more <br />specifically designated on the Crabs Plat of Lot Solit, Assembly <br />and Vacation of Easement of P.P. No. 236-23-11 and P.P. No. 236-23-14, <br />dated February, 1988, and designated in yellow shade, which qlat <br />is attached hereto and marked Exhibit "A". <br />SECTIOW 2: That this Ordinance is hereby declared to be <br />an emergency measure immediately necessary for the preservation <br />of the public health, safety and for the further reason that the <br />existance of the non-utilized easement is causinq unnecessary <br />restriction of use of the propert,y, and further provided it <br />receives the affirmative vote of two-thirds of all members elected <br />to Council, it shall take effect and be in force immediately <br />upon its passage and approval by the Ma,yor.
