CITY OF NORTH OLMSTED <br />ORDINANCE N0. 88- 24 <br />BY: RALPH BOHLMANN <br />AN ORDINANCE ADOPTING A NEW AND REVISED CHAPTER 1361 OF <br />THE CODIFIED ORDINANCES ENTITLED FLOOD DAMAGE <br />PREVENTION. <br />WHEREAS, from time to time it has become necessary to update the Flood <br />Damage Prevention Ordinance to make the same consistent with requirements <br />of both the state and federal government dealing with the subject; and <br />WHEREAS, this Council has been made aware of changes required which are <br />embodied in the within ordinance. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, CUYAHOGA COUNTY, STATE OF OHIO: <br />SECTION 1: That there is hereby adopted a new and revised Chapter 1361 <br />entitled Flood Damage Prevention which new and revised Chapter shall read <br />as follows: <br />SECTION 1361.01: STATUTORY AUTHORIZATION, FINDINGS OF FACT <br />PURPOSE AND OBJECTIVES <br />(a) Statutorq Authorization. <br />ARTICLE XVIII, Section 3, of the Ohio Constitution grants munic- <br />ipalities the legal authority to adopt land use and control measures for <br />proaroting the health, safety, and general welfare of its citizens. <br />Therefore, the Council of the City of North Olmsted, State of Ohio, does <br />ordain as follows: <br />(b) FindinQS of Fact. <br />(1) The flood hazard areas of the City of North Olmsted are <br />subject to periodic inundation whcih may result in loss of life <br />and property, health and safety hazards, disruption of commerce <br />and governmental services, extraordinary public expenditures for <br />flood protection and relief, and impairment of the tax base, all <br />of which adversely affect the public health, safety and general <br />welfare. <br />(c) Statement of Purpose. <br />It is the purpose of this ordinance to promote the public health, <br />safety and general welfare, and to minimize public and private losses due <br />to flood conditions in specific areas by provisions designed to:
