<br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 88- 7 <br />BY: THOMAS 0'GRADY <br />AN ORDINANCE AUTHORIZING THE BUILDING COMMISSIONER TO <br />PROCEED WITH THE DEMOLITION OR REMOVAL OF THE DETACHED <br />GARAGE LOCATED AT 3320 CLAGUE ROAD, IN THE CITY OF <br />NORTH OLMSTED, AND DECLARING AN EMERGENCY. <br />WHEREAS, pursuant to the provisions of Ordinance No. 133.01 and 1331.99 <br />of the Codified Ordinances of the Citp of North Olmsted, the Building <br />Commissioner has determined that the abandoned structure located at 3320 <br />Clague Road, North Olmsted, Ohio, the record title holder being G. McCall, <br />is unsafe, dangerous to human life and hazardous to the safety, health, <br />and public welfare of the citizens of the City of North Olmsted; and <br />WHEREAS, notice to repair, remove, or demolish said building was sent <br />via certified mail, return receipt requested to G. McCall on Maq 11, 1987 <br />at 3320 Clague Road, North Olmsted, Ohio, ordering said title holder to <br />repair, remove, or demolish said building and to commence such repair, <br />removal, or demolition within sixty (60) days of receipt of said notice; <br />and <br />WHEREAS, said record title holder, G. McCall failed to reverse the <br />Building Commissioner's order and also failed to further appeal the <br />decision of the Zoning Board of Appeals to a higher tribunal of competent <br />jurisdiction and this time has failed to comply with the order of the <br />Building Commission. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, CUYAHOGA COUNTY AND STATE OF OHIO: <br />SECTION 1: That Council deems it necessary to proceed with the <br />demolition and removal of the unsafe structure at 3320 Clague Road, North <br />Olmsted, owned by G. McCall, whose mailing address is 3320 Clague Road, <br />North Olmsted, Ohio, by reason of the fact that said structure has been <br />determined to be dangerous to human life and a hazard to the public safetp, <br />health and welfare of the citizens of the City of North Olmsted, Ohio, and <br />that the cost of said demolition and removal be paid from the General Fund <br />of the City of North Olmsted and charged to the owner as a special <br />assessment or lien on such parcel of land and assessed and collected in the <br />manner or other assessments as provided by law. <br />SECTION 2: That the Clerk of Council be and she is hereby directed to <br />forward a copy of this Ordinance to G. McCall at 3320 Clague Road, North <br />Olmsted, Ohio, 44070. <br />1
