CITY OF NORTH OI,MSTED ORDINANCE N0. 88-3 PAGE TWO (b) "User of Pesticides" means any person who applies or causes pesticides to be applied to property or the atmosphere by any means where such person is engaged in applying pesticides for hire to trees, lawns, shrubs and plants. (c) Other definitions: All other definitions set forth in the Ohio Pesticide Law, Ohio Revised Code, Chapter 921, are hereby adopted. 759.02 REGISTRATION OF USERS OF PESTICIDES. (a) On or after April 15, 1988, no User of Pesticides as defined in this Chapter shall engage in the use or application of pesticides within the city limits of the City of North Olmsted, Ohio, without first registering in the office of the Director of Public Safety. The User of Pesticides shall provide proof of a current Ohio Pesticide Law License to be furnished at the time of registration. (b) At the time of the issuance of the registration certificate, the User Qf Pesticides shall notify the Director of Public Safety of the name, address and telephone number of the person, persons, or business and the generic chemical names of pesticides to be used in addition to any other information the Director of Public Safety may deem to be necessary. (c) Engaging in the use or application of pesticides for hire without registering shall be deemed to be a violation of this Chapter. 759.03 REGISTRATION AND NOTIFICATION OF ABUTTING RESIDENTS. All users of pesticides shall give notice of an application of pesticides to all residents abutting the treated area. Notice shall consist of an oral or written pre-notification. If pre-notification fails, the User of Pesticides shall place a notice on the door of the home to be notified that such appli- cation has taken place. 759.04 POSTING OF NOTICE AT PREMISES. Contemporaneous with application, a User of Pesticides shall post on the premises a sign, legible from the abutting sidewalk, indicating the date of application and identifying the chemicals applied. This sign shall remain posted for a full 72 hours and shall be removed by the property owner after the 72 hour period. 759.99 PENALTY. Whoever violates any provisions of this Chapter shall be guilty of a mis- demeanor of the fourth degree and each day during which the violation continues shall be deemed a separate offense." SECTION 2. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council and that all such deliberations of this Council and of any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code.
