CITY OF NORTH OI,MSTED <br />ORDINANCE N0. 88-3 <br />PAGE TWO <br />(b) "User of Pesticides" means any person who applies or causes <br />pesticides to be applied to property or the atmosphere by any <br />means where such person is engaged in applying pesticides for <br />hire to trees, lawns, shrubs and plants. <br />(c) Other definitions: All other definitions set forth in the Ohio <br />Pesticide Law, Ohio Revised Code, Chapter 921, are hereby adopted. <br />759.02 REGISTRATION OF USERS OF PESTICIDES. <br />(a) On or after April 15, 1988, no User of Pesticides as defined in this <br />Chapter shall engage in the use or application of pesticides within <br />the city limits of the City of North Olmsted, Ohio, without first <br />registering in the office of the Director of Public Safety. The <br />User of Pesticides shall provide proof of a current Ohio Pesticide <br />Law License to be furnished at the time of registration. <br />(b) At the time of the issuance of the registration certificate, the <br />User Qf Pesticides shall notify the Director of Public Safety of <br />the name, address and telephone number of the person, persons, or <br />business and the generic chemical names of pesticides to be used <br />in addition to any other information the Director of Public Safety <br />may deem to be necessary. <br />(c) Engaging in the use or application of pesticides for hire without <br />registering shall be deemed to be a violation of this Chapter. <br />759.03 REGISTRATION AND NOTIFICATION OF ABUTTING RESIDENTS. <br />All users of pesticides shall give notice of an application of pesticides <br />to all residents abutting the treated area. Notice shall consist of an oral <br />or written pre-notification. If pre-notification fails, the User of Pesticides <br />shall place a notice on the door of the home to be notified that such appli- <br />cation has taken place. <br />759.04 POSTING OF NOTICE AT PREMISES. <br />Contemporaneous with application, a User of Pesticides shall post on the <br />premises a sign, legible from the abutting sidewalk, indicating the date of <br />application and identifying the chemicals applied. This sign shall remain <br />posted for a full 72 hours and shall be removed by the property owner after the <br />72 hour period. <br />759.99 PENALTY. <br />Whoever violates any provisions of this Chapter shall be guilty of a mis- <br />demeanor of the fourth degree and each day during which the violation continues <br />shall be deemed a separate offense." <br />SECTION 2. It is found and determined that all formal actions of this <br />Council concerning and relating to the passage of this ordinance were adopted <br />in an open meeting of this Council and that all such deliberations of this Council <br />and of any of its committees that resulted in such formal action, were in meetings <br />open to the public, in compliance with all legal requirements, including Section <br />121.22 of the Ohio Revised Code.
