CITY OF NORTH OIMSTID <br />ORDINANCE N0. 91 - 150 <br />BY: Mr. Tallon <br />AN ORDINANCE ACCEPTING A TRAFFIC SIGNAL DETECTOR EASEMENT LOCATED ON <br />PROPERTY OWNED BY LAUREN PROPERTIES LINIITID PARTNERSHIP AND DESIGNATED <br />PARCEL "A" IN THE ASSEMBLY PLAT FOR LAUREN PROPERTIES, INC., AND FURTHER <br />DESIGNATED AS PERMANENT PARCEL N0. 231-31-1 BY CUYAHOGA COUNTY MAPS AND <br />RECORDS, SAID EASEMENT SHOWN ON EXHIBIT "B", AND DECLARING AN EMERGENCY. <br />WHEREAS, Lauren Properties Limited Partnership has agreed to pay all costs <br />and expenses that are the responsibility of the City of North Olmsted for the <br />construction the traffic signal system and the loop detector in its location <br />within the new easement area as shown on the approved plans for the Traffic <br />Signalization Project and as shown on Exhibit "B". <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That City hereby accepts an easement from Lauren Properties <br />Limited Partnership for a traffic signal loop detector, as shown on Exhibit "B". <br />SECTION 2: That the granting of the new easement and construction of the <br />new Traffic Signal System shall be accomplished at the sole cost and expense of <br />Lauren Properties Limited Partnership for the costs and expenses that are the <br />responsibility of the City of North Olmsted. <br />SECTION 3: That the Engineer of the City of North Olmsted is hereby <br />directed to cause said easement to be recorded in the office of the Cuyahoga <br />County Recorder. <br />SECTION 4: That this Ordinance is hereby determined to be an emergency <br />measure necessary for the immediate preservation of the public peace, property, <br />health and safety of the City, and further provided it receives the affirmative <br />vote of two-thirds of all members elected to Council, it shall take effect and <br />be ire force immediately upon its passage and approval by the Mayor. <br />-~~ <br />r <br />,_. <br />~- <br />PASSED : ` L.tr`--L~" .!~ ~~~ <br />ST: <br />1 <br />Sara L.
