.+ TABLED NOVEMBER 6, 1991 CITY OF NORTH OLMSTED ORDINANCE NO. 91-139 BY: DAVID LIND AN ORDINANCE ADOPTING A NEW AND REVISED SECTION 505.08 OF THE CODIFIED ORDINANCES OF THE CITY OF NORTH OLMSTED ENTITLED "NUISANCE CONDITIONS PROHIBITED", OF CHAPTER 505 OF THE CODIFIED ORDINANCES OF THE CITY OF NORTH OLMSTED ENTITLED "ANIMALS AND FOWL" . WHEREAS, this Council has determined that nuisance conditions can and do in fact exist with respect to the keeping and harboring of dogs in residential neighborhoods, depending on the number of dogs and the size of lots wherein said dogs are kept or harbored; and WHEREAS, it is the desire of this Council to regulate the keeping and harboring of dogs in residential neighborhoods. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That there is hereby adopted a new and revised Section 505.08 of the Codified Ordinances entitled "Nuisance Conditions Prohibiting" of Chapter 505 entitled "Animals and Fowl," which new and revised Section shall read as follows: "505.08 NUISANCE CONDITIONS PROHIBITED. (a) No person shall keep or harbor any animal in the City so as to permit the commission or evidence of a nuisance as hereinafter defined. (b) Any animal which disturbs the peace and quiet or endangers the repose or health of persons by frequent or habitual barking, howling or yelping, or which scratches or digs in or urinates or defecates upon any lawn, tree, shrub, plant, building or any other property, private or public, other than the property of the owner or person in charge or control of such animal is hereby declared to be a nuisance.
