.+ <br />TABLED NOVEMBER 6, 1991 <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 91-139 <br />BY: DAVID LIND <br />AN ORDINANCE ADOPTING A NEW AND REVISED <br />SECTION 505.08 OF THE CODIFIED ORDINANCES OF THE <br />CITY OF NORTH OLMSTED ENTITLED "NUISANCE <br />CONDITIONS PROHIBITED", OF CHAPTER 505 OF THE <br />CODIFIED ORDINANCES OF THE CITY OF NORTH <br />OLMSTED ENTITLED "ANIMALS AND FOWL" . <br />WHEREAS, this Council has determined that nuisance conditions can and do in fact exist <br />with respect to the keeping and harboring of dogs in residential neighborhoods, depending on <br />the number of dogs and the size of lots wherein said dogs are kept or harbored; and <br />WHEREAS, it is the desire of this Council to regulate the keeping and harboring of dogs <br />in residential neighborhoods. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That there is hereby adopted a new and revised Section 505.08 of the <br />Codified Ordinances entitled "Nuisance Conditions Prohibiting" of Chapter 505 entitled <br />"Animals and Fowl," which new and revised Section shall read as follows: <br />"505.08 NUISANCE CONDITIONS PROHIBITED. <br />(a) No person shall keep or harbor any animal in the City so as <br />to permit the commission or evidence of a nuisance as hereinafter <br />defined. <br />(b) Any animal which disturbs the peace and quiet or endangers <br />the repose or health of persons by frequent or habitual barking, <br />howling or yelping, or which scratches or digs in or urinates or <br />defecates upon any lawn, tree, shrub, plant, building or any other <br />property, private or public, other than the property of the owner <br />or person in charge or control of such animal is hereby declared <br />to be a nuisance. <br />
