a ~ <br />CITY OF NORTH OLMSTID <br />ORDINANCE N0. 91 - 136 <br />BY: COUNCILWOMAN JANET SARINGER <br />AN ORDINANCE VACATING A PORTION OF A WATER MAIN EASEMENT LOCATED ON <br />PROPERTY NOW OWNED BY COLUMBIA VILLAGE APARTMENTS, PHASE III AND <br />DESIGNATED AT SUBLOT N0. 2 OF THE COLUMBIA VILLAGE SUBDIVISION AS <br />RECORDED IN VOLUME 225 PAGE 89 OF CUYAHOGA COUNTY MAPS AND RECORDS, <br />AND FURTHER ACCEPTING EASEMENTS FROM COLUMBIA VILLAGE APARTMENTS, <br />PHASE III FOR TWO ADDITIONAL WATER MAIN EASEMENTS, AND DECLARING AN <br />EMERGENCY. <br />WI~REAS, Columbia Village Apartments, Phase III has constructed <br />water mains on their property located on the north side of Lorain Road <br />west of Columbia Road, and <br />WHEREAS, it is necessary to vacate a portion of the easement and <br />accept two (2) new easements in order to accommodate the relocated water <br />mains, and <br />WHEREAS, Columbia Village Apartments, Phase III is responsible for <br />all construction cost and expenses for relocation of the water mains to <br />the new location within the new easements. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION l: That a portion of the water main easement located on <br />property now owned by Columbia Village Apartments Phase III be, and the <br />same is hereby vacated, and further that the City hereby accepts two (2) <br />additional easements from Columbia Village Apartment, Phase III, all of <br />which are designated on a "Map of Proposed Water Easements for Carlton <br />Park being part of Sublot No. 2 in Columbia Village Subdivision" dated <br />July 1988 by the Henry G. Reitz Engineering Company, a copy of which is <br />attached hereto, and made a part hereof, as though fully rewritten <br />herein and marked "Exhibit A". <br />SECTION 2: That the granting of the new easements and vacating the <br />portion of the former easement shall be accomplished at the sole cost <br />and expense of Columbia Village Apartments, Phase III. <br />SECTION 3: That the City Engineer be and he is hereby directed to <br />cause an easement vacation and a new easement consistent with this <br />Ordinance be filed with the County Recorder. <br />SECTION 4: That this Ordinance is hereby determined to be an <br />emergency measure necessary for the immediate preservation of the public <br />peace, property, health and safety of the City, and further provided it <br />receives the affirmative vote of two-thirds of all members elected to <br />Council, it shall take effect and be in force immediately upon its <br />passage and approval by the Mayor. <br />
