r CITY OF NORTH OLMSTID ORDINANCE N0. 91 - 135 BY: Councilwoman Janet Saringer AN ORDINANCE ACCEPTING A STORM SEWER EASEMENT LOCATID ON PROPERTY OWNED BY JOSEPH J. SIMMONS AND DESIGNATID AS SUBLOT N0. 299 IN THE S. H. KLEINMAN REALTY COMPANY'S GARDEN CITY ALLOTMENT, AND FURTHER DESIGNATID AS PERMANENT PARCEL N0. 233-22-64 BY CUYAHOGA COLIN'1'Y MAPS AND RECORDS, AND DECLARING AN EMERGENCY. WHEREAS, Joseph J. Simmons has agreed to pay all costs and expenses for constructing the storm sewer in its location within the new easement area as shown on the approved plans for development of Sublot No. 299. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTID, COUNTY OF CUYAHOGA, AND STATE OF OF OHIO: SECTION 1: That the City hereby accepts an easement from Joseph J. Simmons for a new storm sewer which is more fully set out in an easement description on file with the Engineering Department, a copy of which said easement is attached hereto, and made a part hereof, as though fully rewritten herein and marked "Exhibit A". SECTION 2: That the granting of the new easement and construction of the new storm sewer line shall be accomplished at the sole cost and expense of Joseph J. Simmons. SECTION 3: That the Engineer of the City of North Olmsted is hereby directed to cause said easement to be recorded in the office of the Cuyahoga County Recorder. SECTION 4: That this Ordinance is hereby determined to be an emergency measure necessary for the immediate preservation of the public peace, property, health and safety of the City, and further provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
