CITY OF NORTH OLMSTED <br />ORDINANCE N0. 91- 130 <br />$y• Mr. Nashar <br />AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR OF THE CITY OF <br />NORTH OLMSTID TO ENTER INTO AN AGREEMIIVT WITH DALIA CONSULTANTS TO <br />PROVIDE ENGINEERING SERVICES FOR STORMWATER CULVERT AND DITCH <br />IMPROVEMENTS ON THE RICE DITCH, AND DECLARING AN EMERGENCY. <br />WHEREAS, this Council is aware of the fact that the Rice Ditch and <br />Culverts near Sharon and Westchester Drives are in dire need of <br />improvements; and <br />WHEREAS, the Mayor has recommended that the services of the <br />engineering firm of Dalia Consultants be hired to accomplish the <br />aforesaid project due to their expertise in this field; and <br />WHEREAS, upon the recommendation of the Mayor, this Council does <br />hereby express its desire to have the Mayor enter into a contract with <br />said firm for and on behalf of the City. <br />NOW, THEREFORE, BE IT ORDAINID BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTID, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he is hereby authorized and <br />directed to enter into an agreement with Dalia Consultants for the <br />purpose of improving the Rice Ditch and Culverts. <br />SECTION 2: That this Ordinance is hereby declared to be an <br />emergency measure immediately necessary for the preservation of the <br />public health, safety and welfare, and for the further reason that it is <br />immediately necessary to proceed with construction to remedy <br />deficiencies in the Rice Ditch and Culverts, and further provided it <br />received the affirmative vote of two-thirds of all members elected to <br />Council, it shall take effect and be in force immediately upon its <br />passage and approval by the Mayor. <br />/r ~ <br />PASSED : ( ~.._~ .C~.c~ ~S ~ / ~/ ~f / <br />ATTEST <br />~~ <br />BARBARA L.
