CITY OF NORTH OLMSTED <br />ORDINANCE N0. 91-111 <br />BY: Ronald Tallon <br />AN ORDINANCE AUTHORIZING TIIE DIRECTOR OF PUBLIC SERVICE <br />TO MAKE EMERGENCY REPAIRS ON THE SANITARY MANHOLES NEAR <br />THE WASTEWATER TREATMENT PLANT, WITHOUT PUBLIC BIDDING, <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, recent inspection by the City of the sanitary manholes on Sheppard's <br />Hill, near the Wastewater Treatment Plant has indicated that the manholes are in <br />immediate need of replacement; and <br />WHEREAS, the aforesaid problem has reached such a critical state that public <br />bidding and the time associated therewith would be too time consuming to meet the <br />City's obligation to protect the public health, safety and welfare; and <br />WI-~REAS, upon the recommendation of the City Engineer, this Council deems it an <br />emergency sufficient in magnitude to forego public bidding on said project in order <br />to protect the public health, safety and welfare of the residents of the City. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, <br />COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the Director of Public Service is hereby authorized to solicit <br />estimates for the repair of the aforesaid sanitary manholes and that upon receiving <br />satisfactory estimates from more than one contractor, said estimates shall be <br />presented to the Board of Control, and, upon the approval of the Board of Control, <br />the Mayor, be and he is hereby authorized to enter into a contract for the repair of <br />said sanitary manholes. <br />SECTION 2: That this ordinance is hereby declared an emergency measure necessary <br />for the preservation of the public health, safety and welfare, and for the further <br />reason that it is immediately necessary to protect the residents and further provided <br />it receives the affirmative vote of two-thirds of all members elected to Council, it <br />shall go into immediate force and effect upon its signing by the Mayor. <br />Passed : ~,S / f <br />ATTEST: <br />' ARBARA L.~ S)EMAN, CLERK OF COUNCIL JAMES D.
