Failure to pay the assessed costs within <br />ninety days shall constitute a violation of this chapter <br />enforceable under the provisions of Section 501.99 of the General <br />Offenses Code. <br />(c) (1) No person shall lmowingly make ~y false statement, <br />representation or certification in arty application, <br />record, report, plan or other docwnent filed or required <br />to be maintained pursuant to the Codified Ordinances or with <br />purpose to mislead a public official in performing his <br />official function. <br />(2) No person shall, without privilege to do so, Imowingly damage <br />or improperly tamper with any monitoring device or method <br />required or authorized under the Codified Ordinances. <br />(3) Whoever violates subsection (c) (1) and (2) hereof is guilty <br />of a misdemeanor of the third degree." <br />BE AMID THE SAME IS HEREBY AMIIVDID A1~ID AS AMENDID SHALL READ AS FOLLOWS <br />"917.99 PEi~IALTY. <br />(a) Administrative Enforcement Remedies <br />(1) Notification of Violation <br />Whenever the Superintendent finds that any industrial user has <br />violated or is violating this Ordinance, or a wastewater permit or order <br />issued hereunder, the Superintendent or his agent may serve upon said <br />user written notice of the violation. Within 10 days of the receipt <br />date of this notice, an explanation of the violation and a plan for the <br />satisfactory correction and prevention thereof, to include specific <br />required actions, shall be submitted to the Superintendent. Submission <br />of this plan in no way relieves the user of liability for any violations <br />occurring before or after receipt of the notice of Violation. <br />(2) Consent Orders <br />The Superintendent is hereby empowered to enter into Consent <br />Orders, assurances of voluntary compliance, or other similar doc~nents <br />establishing an agreement with the industrial user responsible for the <br />noncompliance. Such orders will include specific action to be taken by <br />the industrial user to correct the noncompliance within a time period <br />also specified by the order. Consent Orders, shall have the same force <br />and effect as administrative orders issued pursuant to Section 917.99 <br />(a) (4). <br />(3) Show Cause Hearing <br />The Superintendent may order any industrial user which causes or <br />contributes to violation of this Ordinance or wastewater permit or order <br />issued hereunder, to show cause why a proposed enforcement action should <br />not be taken. <br />-9- <br />
