CITY OF NORTH OLMSTED <br />ORDINANCE 91-90 <br />BY: COUNCILMAN NASHAR <br />AN ORDINANCE ACCEPTING VARIOUS STORM SEWER EASEMENTS LOCATED IN THE <br />PHEASANTS WALK SUBDIVISION IN THE CITY OF NORTH OLMSTED, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, Hennie Homes, Inc., has agreed to pay all costs and expenses for <br />constructing a storm sewer in its location within the new easement areas as <br />shown on the plan of the Proposed Rear Yard Drainage System, which is marked <br />"Exhibit A" and attached and made part of this Ordinance. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION l: That the City hereby accepts the easements from the various <br />owners of property in the Pheasants Walk Subdivision, including sublots 40 <br />through 46, and sublots 55 through 61, as noted on "Exhibit A" (attached) for a <br />new storm sewer, and which is more fully set out in individual easement <br />descriptions on file with the Engineering Department, a copy of which said <br />easements are attached hereto, and made a part hereof, as though fully rewritten <br />herein and marked "Exhibit B". Said easements for sublots 40 and 41 shall <br />adjoin the Pheasants Walk Drive to permit access by the city from the right-of- <br />way. <br />SECTION 2: That the granting of the new easements and construction of the <br />new storm sewer line shall be accomplished at the sole cost and expense of <br />Hennie Homes, Inc., and that each lot shall have its own rear yard drain located <br />outside of the easement which may be connected to the sewer within the easement. <br />SECTION 3: That the Engineer of the City of North Olmsted is hereby <br />directed to cause said easements to be recorded in the office of the Cuyahoga <br />County Recorder. <br />SECTION 4: That this Ordinance is hereby determined to be an emergency <br />measure necessary for the immediate preservation of the public peace, property, <br />health and safety of the City, and further provided it receives the affirmative <br />vote of two-thirds of all members elected to Council, it shall take effect and <br />be in force immediately upon its passage and approval by the Mayor. <br />
