<br />. ` <br />,~, <br />EASEMENT <br />KNOW ALL PIIZSONS BY THFSE PRESENTS that I~II~TIE HC~S INppRppRATED <br />being the owner of the real property ca~~only ~~ ~ Sublots 42, 43 and <br />59 of the Pheasants Walk Subdivision, North OLnsted (Ctiyahoga County), Ohio <br />44070, permanent parcel numbers 233-25-017, 233-25-018, and 233-25-065, <br />respectively, recorded in Volume 237, Page 50 of the Records of the Cuyahoga <br />County Recorder (the "Property"), in consideration of the sum of Ten Dollars <br />($10.00) and other good and valuable consideration, receipt of which is hereby <br />acknowledged, does hereby grant and convey to the City of North Olmsted, <br />("Grantee"), whose address is 5200 Dover Center Road, North Olmsted, Ohio 44070 <br />a perpetual easement for: <br />(a) any and all surface and subsurface water drainage purposes <br />in, on, upon, under, over or across the portion of the Property <br />described as ten (10) feet parallel and adjacent to the rear property <br />line and shown on Exhibit A attached hereto and made a part hereof <br />(the "Easement Area"); <br />(b) the right to install, use, maintain, operate, service, repair, <br />replace, or remove any facilities that Grantee may deem necessary or <br />appropriate for surface and subsurface water drainage in, on, upon, <br />under, over or across the portion of the Property as ten (10) feet <br />parallel and adjacent to the rear property and shown on Exhibit A <br />attached hereto and made a part hereof (the "Easement Area"); and <br />
