Except as Grantee deems necessary for surface and subsurface <br />vatar drainage purposes or as otherwise needed in the exercise of <br />Grantae~s easement rights hereunder, Grantee, upon the exercise <br />of any of its rights under this Easement, shall restore the <br />Easement Urea to its condition prior to any acts by Grantee, as <br />is reasonably practicable. <br />Grantee shall indemnify and save Grantor harmless from and <br />against any claims, losses, costs, damages, liabilities and <br />expanses, causes of action, claims, demands or judgments directly <br />arising from or caused by Grantee's use of the Easement Area. <br />Grantor shall cause any existing mortgage upon Grantor~• <br />Parcel to be subordinated to Grantees rights under this Grant of <br />Easements by an instrument satisfactory in form and substance to <br />Grantee. <br />The easements granted herein and all of the terms, <br />restrictions, covenants and agreements sat forth in this Easement <br />are intended to be and shall ba construed as covenants (and not <br />conditions) running with the land and shall be binding upon and <br />shall inure to the benefit of and ba enforceable by Grantor and <br />Grantee and their respective heirs, successors or assigns. <br />Grantor covenants that (a) Grantor is the owner of the <br />Property and Easement Area; (b) Grantor has the right, title and <br />
