Except as Grantsa deems necessary for surface and subsurface <br />voter drainage purposes or as otherwise needed in the exorcise of <br />Grantea~s easement rights hereunder, Grantsa, upon the exercise <br />of any o! its rights under this Basement, shall restore the <br />Easement Area to its condition prior to any acts by Grantee, as <br />is reasonably practicable. <br />Grantee shall indemnify and save Grantor harmless from and <br />against any claims, losses, costs, damages, liabilities and <br />expanses, causes of action, claims, demands or judgments directly <br />arising from or caused by Grantees use o! the Easement Urea. <br />Grantor shall cause any existing aortgaga upon Grantor~• <br />Parcel to ba subordinated to Grantae~• rights under this Grant of <br />Easements by an instrument satisfactory in loan and substance to <br />Grantsa. <br />The easements granted herein and all of the terms, <br />restrictions, covenants and agreements sat torth in this Easement <br />are intended to be and shall be construed as covenants (and not <br />conditions) running with the land and shall be binding upon and <br />shall inure to the benefit of and be enforceable by Grantor and <br />Grantee and their respective hairs, successors or assigns. <br />Grantor covenants that (a) Grantor is the owner of the <br />Property and Easement l~irea; (b) Grantor has the right, title and <br />
