CITY OF NORTH OLMSTED <br />ORDINANCE NO. 91-62 <br />BY: Councilman James Leonard <br />AN ORDINANCE AMENDING CHAPTER 941 OF THE CODIFIED <br />ORDINANCES OF THE CITY OF NORTH OLMSTED ENTITLED <br />"REFUSE COLLECTION" BY ADDING THERETO A NEW <br />SECTION 941.03 ENTITLED "STORAGE OF REFUSE - COM- <br />MERCIAL ESTABLISHMENTS" AND DECLARING AN EMER- <br />GENCY. <br />WHEREAS, this Council has been advised that in some instances, commercial estab- <br />lishments have been temporarily storing refuse in plastic bags prior to the delivery of the <br />refuse to refuse containers; and <br />WHEREAS, it is the belief of this Council that not only does the practice of doing the <br />aforesaid constitute a health hazard, it also creates a blight upon the community; and <br />WHEREAS, it is the desire of this Council to regulate such activity. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That Chapter 941 of the Codified Ordinances entitled "Refuse Collec- <br />tion" is hereby amended by adding thereto a new Section 941.03 entitled "Storage of Refuse - <br />Commercial Establishments", which will read as follows: <br />"Whenever refuse is generated as a result of the operation of commercial <br />establishments as hereinbefore specified, all such refuse shall be immediately <br />placed in containers provided for such refuse, and in no event shall any indi- <br />vidual owner or operator of said commercial establishment cause the refuse to <br />be placed or stored in an area other than that designated for said refuse, and <br />further said refuse shall be placed in containers consistent with those provided <br />for in 941.01(C)(3) of this Chapter. " <br />SECTION 2: That this Ordinance shall supersede any and all ordinances or parts of <br />ordinances inconsistent herewith. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />further reason that it is immediately necessary to implement the provisions of this Ordinance in <br />order to protect the health, safety and welfare of the residents of the City of North Olmsted, <br />and further provided it receives the affirmative vote of two-thirds of all members elected to <br />
