CITY OF NORTH OLMSTED <br />ORDINANCE NO. 91-56 <br />BY COUNCILMAN THOMAS O'GRADY <br />AN ORDINANCE ESTABLISHING A LAW ENFORCEMENT <br />ALCOHOL EDUCATION AND ENFORCEMENT FUND PURSU- <br />ANT TO O. R. G 4511.99 AND DECLARING AN EMERGENCY. <br />WHEREAS, Ohio Revised Code Section 4511.99 authorized payment, to Law En- <br />forcement Agencies primarily responsible for arrests of an offender under Ohio Revised Code <br />4511.19, a portion of the fine imposed for purposes of alcohol education and enforcement; and <br />WHEREAS, in order to receive such payments, the municipality establish a Law En- <br />forcement Alcohol Education and Enforcement Fund; and <br />WHEREAS, this Council deems it advisable to establish the Law Enforcement Alcohol <br />Education and Enforcement Fund to receive said payments, the monies from which: <br />"To pay only those costs it incurs in enforcing Section 4511.19 of <br />the Revised Code or a substantially similar municipal ordinance <br />and in informing the public of the laws governing operation of a <br />motor vehicle while under the influence of alcohol. The dangers <br />of operation of a motor vehicle while under the influence of <br />alcohol and other information relating to the operation of a motor <br />vehicle and the consumption of alcoholic beverages and such other <br />purposes permitted by law in the future. " <br />NOW, THEREFORE, BE,IT ORDAINED BY THE CITY OF NORTH OLMSTED, <br />COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That pursuant to Ohio Revised Code Section 4511.99 the City of North <br />Olmsted does hereby establish a Law Enforcement Alcohol Education and Enforcement Fund <br />which shall consist of portions of fines determined by courts and paid to North Olmsted Law <br />Enforcement Agencies which had the primary responsibility for the arrest of offenders of Ohio <br />Revised Code Section 4511.19 and, <br />"Shall be used to pay only those costs it incurs in enforcing Section <br />4511.19 of the Revised Code or a substantially similar municipal <br />ordinance and in informing the public of the laws governing <br />operation of a motor vehicle while under the influence of alcohol. <br />The dangers of operation of a motor vehicle while under the <br />influence of alcohol and other information relating to the operation <br />of a motor vehicle and the consumption of alcoholic beverages." <br />And such other purposes permitted by law in the future. <br />
