AGREEMENT REGARDING CAPITAL CHARGES <br />FOR SEWER IMPROVEMENTS <br />TffIS AGREEMENT REGARDING CAPITAL CHARGES FOR SEWER IMPROVEMENTS (the <br />"Capital Agreement") is made and entered into as of January 1, 1991, by and <br />between the City of North Olmsted, Ohio ("North Olmsted"), by its Mayor and <br />Director of Finance, duly authorized in its behalf by Ordinance No. 91-_ <br />fussed by its Council on 1991, and the City of Fairview Park, <br />Otiio ("Fairview Park"), by its Mayor and Director of Finance, duly authorized <br />in its behalf by Ordinance No. 91-_ passed by its Council on , <br />1991, in accordance with the Sewer Service Agreement dated January 1, 1990 be- <br />tween North Olmsted and Fairview Park (as amended or supplemented from time to <br />time, the "Operating Agreement"). <br />WfIEREAS, North Olmsted owns and operates a sanitary sewer system (the <br />"North Olmsted Sanitary Sewer System"), which includes a collection system, <br />lift stations, a wastewater treatment plant and appurtenances and which col- <br />lects and treats certain wastewater originating in the Service Area (as de- <br />fined in ttie Operating Agreement) within the former Village of Parkview <br />("Parkview") and now within Fairview Park; and <br />WHEREAS, North Olmsted and Parkview entered into an agreement for the <br />conveyance of wastewater from the Service Area to the North Olmsted wastewater <br />treatment plant and for the use of that plant to treat wastewater from the <br />Service Area, dated April 3, 1962 (the "Prior Agreement"), a copy of which is <br />attached to the Operating Agreement as Exhibit A; and <br />
